A federal judge on Tuesday ruled that the U.S. law banning female genital mutilation was unconstitutional and dismissed charges against several doctors in Michigan who carried out the procedure on underage girls as part Muslim sect’s religious practice.

 

U.S. District Judge Bernard Friedman ruled that Congress had no authority to enact a law that criminalizes female genital mutilation (FGM). “As despicable as [FGM] may be… [Congress] overstepped its bounds” by banning the procedure, the judge said.

I'm confused. If it has been ruled unconstitutional at a federal level, how would a state law overrule it. :dunno:

I think we all agree that I'm not exactly a raging feminist, but I think that's just cruel.

I prefer a more specific form of female mutilation too. Like acid on the whole face is sort of vague, but theyll wonder why I cut off just the one nipple.

Congress uses the commerce clause to hang it's hat on everything it does on a federal level. The Judge rules there was no interstate commerce here, thus no federal jurisdiction.

They might not be rallying, but there has been a push toward not cutting for awhile now.

 

My sons are 9 and 11 and there was a whole big discussion we had to have with the docs about pros and cons and cosmetic elective surgery.

I'm generally in favor of the more local the better, but this kinda strikes me like one state will outlaw it and the next state over won't, people will travel to the next state to mutilate their daughter's genitals. I can't believe I just typed those last few words. Can we not agree on a national level that this is wrong? :(

Transporting severed clits across state lines is definitely wrong.

This is legal in a number of states. Basically this judge is saying this issue should be legislated similarly.

Yes, murder is a state crime. The punishments may differ, but it isn't like I can go to the next state over to murder someone in my state. I'm a little concerned that whackjob states like CA and NY might not get around to, you know, making it illegal. Guess we'll see. :dunno:

Yeah, its not like he was encouraging elected officials to ignore the law of the land and allow illegal immigrants to stay in their cities, wait, is that wrong or OK? This fluidity is confusing sometimes.

I took a whole can of Frijoles, refried beans made with lard and mixed it with Spanish rice made with jalapenos fresh and then mixed in the remaining fajita meat and onions and peppers and the burritos out of it with queso on top.

 

Talk about your mutilated shiitters.

You conservatives should love this ruling. You always say you want a strict constitutionalist. This is such a ruling. There is nothing in the constitution that gives the federal government the authority to regulate such matters. Case closed.
