GM to seek court protection against ignition lawsuits

(Reuters) - Signaling a tougher stance toward legal claims stemming from its recent recall over faulty ignition switches, General Motors Co said it will ask a U.S. court to bar lawsuits related to actions before its 2009 bankruptcy.

 

GM has previously said it is protected from liability for claims related to incidents that occurred before it exited bankruptcy in 2009. But it has now taken its first steps to raise those issues with the court by filing motions to stay recall-related lawsuits while it asks that bankruptcy court to clarify the extent of that protection.

 

In a filing with the U.S. District Court for the Southern District of Texas on Tuesday, GM asked for a stay on litigation related to ignition claims until a judicial panel on multidistrict litigation decides on a motion to consolidate the case with other lawsuits and the bankruptcy court rules on whether the claims violate GM's 2009 bankruptcy sale order. The company earlier filed a similar motion with the U.S. District Court for the Northern District of California seeking a stay on pending litigation. (r.reuters.com/paw58v)

 

The plaintiffs in those cases have alleged that they bought or leased vehicles that contained an ignition switch defect. The defect has been linked to the deaths of at least 13 people and resulted in the recall of 2.6 million GM vehicles.

Thirteen people over a period of 7 years? Not only that, one of the women that died was speeding, drunk, and not wearing her seatbelt. How could that death be blamed on a faulty ignition switch.

 

Yes this is something that should be investigated, but this really should be a much smaller story.

Linked to and cause by are very different things.

 

Same way a drunk guy staggering into the street and getting hit by a car is added to the "alcohol related deaths" category, lazily interpreted as deaths cause by drunk drivers.

I do not remember you or giants fan defending GM, are there any other practicing socialists on this board that I am missing?

 

From my interpretation of your posts you are defending the Congressional hearings on this issue and are supporting larger government intervention in this matter. You supporting a nanny state where the government protects us from each and every little defect is consistent with socialism.

 

I support a much smaller government intervention. I think GM should be fined and then this issue should be dropped.

Not sure how a union contract caused bankruptcy removes their liability.

 

Now had they actually failed and gone out of business their liability would have likely ended, but that isn't what happened.

 

Bankruptcy removes their liability to creditors, not consumers.

DETROIT – General Motors waited years to recall nearly 335,000 Saturn Ions for power steering failures despite getting thousands of consumer complaints and more than 30,000 warranty repair claims, according to government documents released Saturday.

 

The National Highway Traffic Safety Administration, the government's auto safety watchdog, also didn't seek a recall of the compact car from the 2004 through 2007 model years even though it opened an investigation more than two years ago and found 12 crashes and two injuries caused by the problem.

 

The documents, posted on the agency's website, show yet another delay by GM in recalling unsafe vehicles and point to another example of government safety regulators reacting slowly to a safety problem despite being alerted by consumers and through warranty data submitted by the company.
