Am I overreacting?

I placed a deposit with a shop for a build on my weekend car on 3/16. The plan was to start the build in November. I contacted the shop on 3/29 to cancel my build. I made this decision for multiple reasons, but the primary ones were 1) a former customer of theirs informed me that their warranty policy is complete bullchit. They will not stay true to their word if something happens. 2) The shop closest to me, which also happens to be the top shop for this type of car, is coming out with a turbo kit that fits exactly what I want.

 

I didnt hear back from the shop after requesting the refund for a week and a half, so I followed up. They responded that theyd get back to me later that day. 2 days later, still nothing. So I followed up again yesterday. The owner emails me back and says this is a hairy situation. He said the invoice clearly states that there is a restocking fee for any builds that are canceled. Well thats 100% false. Theres nothing on the invoice stating that and he never mentioned it previously. I told him if he had already ordered some custom parts, I would completely understand passing the costs along. But he hasnt ordered anything and likely would not have ordered any parts until September or October.

 

Im waiting for a call from him on Monday, but I already know where this is going. Im debating whether to call my credit card company and/or an attorney.

 

I was focking pissedd yesterday. Am I overreacting?

No you re not. They seemingly are trying to fock you. the man lied to you. Also the former customer had the right of it, it seems it isn't just their warranty policy that is bullsh*t.

 

Just, before you get too bent out of shape, see how that Monday call goes. Maybe things'll clear up.

Appreciate the feedback guys. Based on my conversation with the previous customer, the owners response is playing out exactly as I was expecting. I cant believe no one has blasted him on the forum he is heavily involved in.

 

Hopefully things work out, but I am not optimistic.

Not at all man. He didnt order anything yet. He should be understanding that changes, and he should consider the good will of helping you out at mo extra cost good for business

I post on many boat forums. Deposits on custom builds are typically non refundable.

 

I can see both sides of this. What does your contract say?

I would completely understand this if it was made known in advance. Typically, a deposit is used to purchase parts. If someone cancels their build, they can decide whether to take ownership of the parts, or receive a refund (less restocking fees). The shop hasnt ordered any parts and likely would not order any until September or October. So at this point, I have received nothing and have no option to take ownership of anything.

 

There is no contract. I placed a deposit simply to hold pricing. There were no terms and conditions. No email correspondence stating anything about the deposit being non-refundable. All I have is an invoice (their quote of parts/labor) showing the deduct off the total for my deposit.

I called my credit card company to explain what is going on. They filed a dispute. They said unless I signed a contract that details how restocking/cancelation fees are determined, the shop cannot hold back any of the refund.

 

Im going to give the shop a chance to make it right. If they dont, Ill let the credit card company handle it.

The car runs great. My intent is to build the engine, transmission and upgrade turbos for more power.

The deposit was 20k. Does that mean the total is even more? 20k on the credit card seems like an awfully high single cc purchase. Is this common around here?

Not for me. I have paid for vacations with it and other everyday purchases. Cash back program makes it worthwhile. Protection in a situation like this may also be a benefit.

Youd need to make/spend a sh1tload of money to have a credit card with a limit well over 20k (Im assuming you arent dumb enough to max out the limit).

 

So gladiators is either full of it or what you would call a high roller even for the Geek Club where we all make 200k and have supermodel wives

Not to mention spend more than 20k on work on a car you dont even drive.

Closing the loop on this.

 

Shop owner never called me. I followed up again last Friday because I wanted to resolve without involving my credit card company. No response Friday or Monday. Received a response today apologizing for not getting back to me. He received a letter from my credit card company and claims they have withdrawn the money. He tried blaming me for not following up enough, which is hilarious considering I followed up with him 4 or 5 times. All he needed to do was call or email me back to resolve. Never did.
