President Donald Trump fired back Wednesday after Chief Justice John Roberts issued a rare rebuke of the President's disparaging remarks about federal judges.

 

"We do not have Obama judges or Trump judges, Bush judges or Clinton judges," Roberts said in a statement responding to comments Trump made earlier in the week criticizing the US 9th Circuit Court of Appeals. "What we have is an extraordinary group of dedicated judges doing their level best to do equal right to those appearing before them. That independent judiciary is something we should all be thankful for."

Trump, in a response later Wednesday, stood by his comments from the previous day that prompted Roberts' statement.

"Sorry Chief Justice John Roberts, but you do indeed have 'Obama judges,' and they have a much different point of view than the people who are charged with the safety of our country. It would be great if the 9th Circuit was indeed an 'independent judiciary,' but if it is why......" Trump tweeted.

Several minutes later, he continued, ".....are so many opposing view (on Border and Safety) cases filed there, and why are a vast number of those cases overturned. Please study the numbers, they are shocking. We need protection and security - these rulings are making our country unsafe! Very dangerous and unwise!"

They could have the lawsuit written up and filed say in AL or TX minutes after he makes the order. They could rule in his favor before a suit is filed in the 9th then they would have to appeal to a higher court. There must be a reason that is not done. Because you know it is stacked in the 9th and the ruling is known there before the suit is even written up.

Question for the law geeks. I always wonder why a conservative group does not file a lawsuit first in a Federal district more likely to rule in their favor and take it out of the 9ths jurisdiction? Is that something that can be done? So Trump could say something to a conservative group like here is an order I am putting out today. Circuit court rulings are only binding on the states that are in that circuit.

 

So until the supreme Court weighs in, you would have different law in different parts of the country. That is why the supreme Court often takes certain cases. To clear up areas of law where the circuits differ.

 

We were always told in law school to never cite the 9th circuit. Rulings from other circuits are called persuasive authority, as opposed to binding authority. And nobody outside of the 9th circuit takes their rulings seriously.

There's a reason people will file in certain districts (the 9th for example) Lawyers will judge shop to find a Judges whose political beliefs line up with the case they want to win.

 

Look at the supreme court. When they do split it's usually always at the party line just like in congress.

Generally, groups file a lawsuit related to something they are against. So youd be asking conservative group to fake a lawsuit and intentionally lose to block a future lawsuit? I feel like that would be problematic on several legal levels.

Other than a handful of times where I specifically knew good or bad things, I've never voted for local judges. I don't feel like I know about them to vote one way or another. I could just vote along party lines but that seems wrong somehow.

What I mean by non binding is that lower courts in other circuits don't have to follow it's precedent.

 

It applies all over the country I assume because it is, at the moment, the highest court to rule on it. Eventually, some other circuit will rule otherwise, and scotus will eventually resolve the conflict.

The integrity of the courts specifically the 9th speak for themselves. Roberts should know better than anyone. Considering how bad their overturned rulings percentage is there's no defending them.
