Stand your ground law

Seems like there needs to be a legitimate fear for ones imminent death for this to apply, but I don't really know how the law is worded. Regardless, seems like a stupid way to die.

 

I guess if it works for cops every damn day...

Yeah, I don't see how this guy isn't going to be arrested since HE is the one who started the incident. This is not what Stand Your Ground laws were designed to protect against.

 

However, we should have a discussion on non-handicapped people parking in handicap spots. Instead of getting killed, this dude and his girlfriend should have got just a simple ass-whipping - and a ticket - instead.

Like I said, why should cops be the only people who get to enjoy this?

 

I shot him 17 times! I feared for my life!

 

But he didn't have a gun, he was reaching for the salt shaker...

 

 

Still, I feared for my life! And how I feel is all that matters!

 

That's exactly how the sheriff is enforcing this one. He's completely leaving out the part about reasonable fear for ones life.

Maybe, but some places are ridiculous. When the first 3 rows comprising 36 different spaces are all reserved for handicapped and you know that you don't even have 5 people in your whole damn town in wheelchairs, something's got to give.

 

Plus, they've got wheels, it should be easier for them. It's not like they're dragging their stumps up to the popcorn stand. In that case, yeah give him a parking space in the lobby for all I care.

 

Besides, equal rights and handi-capable right? Hell these suckers are running marathons. They can't make it another 15 feet to the movie theater?

Mayyybeee before you escalate something to using violence you should think about the fact someone could be packing. Words are words. This is the fault of the dumb didnt do nothing gf who lies about the parking lot being packed causing her to park in the spot.

nope guy should be charged with murder, sorry, but he was harassing the guys wife getting in her face thru the window, the guy walks out of the store, I would do the same thing.

 

at that point it was over, shooting him was unnecessary

Florida's "Stand Your Ground" law, which was enacted in 2005, allows residents to use force, including deadly force, if they "reasonably believe" they are at risk of death or great bodily harm. The law specifies that people have "no duty to retreat" from their homes or vehicles if they feel threatened.

Also. The sheriff basically punted to the states top cop.

 

"This will go to the state attorney. Drejka will not be charged [and] will not be arrested by us," Sheriff Gualtieri said. "The state attorney will review it and either he’ll concur or not. And, if he concurs, then there’ll be no charge. Period. If he doesn’t concur, then he’ll make a determination as to what to do with it. And, if he feels like he can overcome that heavy burden at a Stand Your Ground hearing of proving by clear and convincing evidence that Drejka was not entitled to use force in this circumstance, then that’s the state attorney’s determination to make."

Also, don't be fuckin stupid. Assume everyone else is stupid and possibly is stupid with a gun. It's almost always a retard that either is the shooter, the dead guy or both.

 

Seems like this idiot was looking for trouble and a chance to use his gun. An idiot gave him the opportunity.

Well thats just murder.

He starts an argument. Then he gets shoved. Then from 10 ft away, he pulls the gun and aims. Victim isnt making a move. Then the guy may briefly aim at the women, then back to the guy...waits a few seconds with no move being made towards him still, thinks on it, and decides to shoot.....then as the victim retreats into the store, he keeps the gun trained on him, which may make sense but nonetheless....

I guess if the victim was yelling mean things....because that can be scary if you are the type guy to pull a gun because of a shove.

Black guy was previously confronted for same parking situation. In that instance he (AA guy) says he's gonna shoot.

 

May have happened in this case too.

 

If AA guy slams him to the ground and says "I'm going to pop a cap in yo ass" it's totally justified to stand your ground.

Looks like Frozen got his concealed carry early.

I am way better looking than the shooter.

 

That was straight murder. If that is how I use my handgun, then I deserve to go to prison. What a scum bag. I don't ever want to kill anyone. Zero fantasies of actually shooting someone here.

People that carry guns have the responsibility to de-escalate situations, as they can result in shooting incidents.

 

Arguments should not be death sentences. Responsible gun owners would do everything in their power to avoid them.

The store owner has confirmed that the shooter had a bug up his ass about people who Park in the handicap space. And in particular, black people.

 

In the same story, the interview another black guy who was confronted by the shooter previously. So that's at least two different Witnesses saying that this guy basically hung around the store waiting to pick a fight.

 

He finally got one.

Strangely enough, this sheriff is actually a lawyer as well.

 

But I can sort of see it. The way the law is written, heys taking the letter of the law. Moreover, like I said in my first post, if you've got cops who can get off after shooting people who are unarmed strictly by saying the magic words "I feared for my life," then why the hell shouldn't normal citizens get away with the same standard? Especially with a stand your ground law in place?

 

I wouldn't be entirely surprised if the sheriff is trying to make a point. They recently upgraded or downgraded depending on how you look at it the stand-your-ground law to apply outside of your home and vehicle. This is the ridiculous logical extreme.

 

What he fundamentally misses though, is that the verbage didn't change regarding a reasonable fear for one's life. Getting shoved does not equate to a reasonable fear of imminent death.

 

If so, the next Black Friday is going to be a Bloodbath.

There are very few instances where I understand a riot. If black people did some destruction over this one I wouldn't blame them. But not too much. Don't burn the whole place down

I wouldn't have drawn my firearm in that situation, but that guy that did the shooting wasn't the first one to get handsy. It was just words until Leroy had to protect his guuuuuuuurl dog.

 

Also, so what if they guy was bitching at her? They parked in a handicap spot, that's against the law. What especially pissed me off is the girl saying in the interview is "all these spots belong to me" or something like that. All of you saying you would have "ran out and done the same thing" shut the fock up.. you would make something verbal turn physical? Yeah you can get shot too.

There's a clause that says you can't be doing anything illegal leading up to the shooting.

 

And the proposed clause would be irrelevant in this case, as he didn't initiate the confrontation with the guy he shot. The confrontation was initiated when the guy who got shot blindsided the shooter.

We typically blame the gun, right? I have to give the shooter the benefit of the doubt here and say it was the guns fault.

 

On a more serious note, I cant believe the guy wont get charged. No reasonable person would fear for their life in that situation. And if all it takes for you to be fearful for your life is someone pushing you, then you should not start a confrontation to begin with. Call the police, go talk to the store manager, or suck it up and keep your mouth shut.

 

If this guy doesnt get charged, I could see a helll of a lot more of these situations occurring. Every single gang banger in Florida that kills someone could say the dead guy pushed them and they feared for their life.

So if I want someone dead, I just confront them and talk shiit until they shove me. Then I get to shoot them.

 

Thats actually pretty simple and straightforward, as I used to be quite skilled at getting guys riled up.
