Firing of New York teacher found with heroin too harsh, judge rules

Recommended Posts

NEW YORK – A high school teacher who was fired earlier this year for showing up for jury duty with 20 glassine envelopes of heroin stashed in a pack of cigarettes could get his job back.

A judge found that Damian Esteban's firing was "unduly harsh" and ordered the Department of Education to impose a lesser punishment. City officials blasted the decision on Thursday, saying they would appeal.

"We cannot fathom how a teacher who took 20 bags of heroin into a courthouse is fit to stand in front of a classroom and teach the city's school children," Michael A. Cardozo, the city's top lawyer, said in a statement.

Interesting because there is Supreme Court precedent to support the DOE to fire him. They have to be able to prove that this charge will effect his ability to conduct his teaching duties without substantial disruption to the learning environment. This means if the parents and students don't care, then he can continue to teach.

Greta. He can join the large group of horrible ny teachers who get paid to sit in rooms all day and do nothing cause they cannot be fired.

A substitute art teacher in Pennsylvania got high with heroin before work and then passed out in front of students in class, police said.

Christopher Chiappetta, 26, allegedly shot up at 6 a.m. on Wednesday morning before going to Northgate High School in Pittsburgh for a day's work, CBS Pittsburgh reported.

Other staff became suspicious when, just before noon, he left the building for a break.

When he returned, school resource officer Sgt. Mike Hudson went to check on the class and found him slumped over his desk and fast asleep.
