Ex NFL lineman and wife found murdered...son charged

Sad. So this kid was in a mental health facility making specific threats and still had or purchased a 9mm? Sorry 2A people, this is the kind of stuff where you lose normal people who want reasonable, common sense gun policy.

Shoulda had his guns confiscated or not be allowed to purchase a gun, given his situation.

This is a breakdown in policing the situation, no new laws necessary.

I am a 2A guy.

Don't fall for the 'we've got to do something about nutjobs buying guns' until you find out whether or not the pistol was indeed his.

It might have been his parents or a friend's in which case there can be no defense against that UNLESS the hospital where he made the threats to kill them told his parents of the threats. Had that occurred they most likely would have taken precautions in being around him.

Again..................reserve judgement until you find out if the pistol was his or not.

Why would we "lose normal people" over this kind of stuff when there are already laws on the books that prohibit people who have been adjudicated mentally defective from purchasing or possessing firearms?  :dunno:

Maybe "normal people" should educate themselves on the "common sense" gun laws already in place before deciding we need more gun laws.

Well, let's say he purchased his gun before he went into the mental health facility and made his threats. What then?

If he's been adjudicated mentally defective he should have his guns removed from his possession. It makes no sense to have the laws on the books if we aren't going to enforce them.

Ok, but how would the authorities know he had one?

If he purchased his gun legally he would have had to pass a background check which includes mental health...

"BATFE form 4473 question 11f: Have you ever been adjucated mentally defective

BATFE form 4473, q.11f: Have you ever been adjucated mentally defective (which includes having been adjudicated incompetent to manage your own affairs) or have been committed to a mental institution? Y/N

Answer yes to that question and you're not getting the gun you intended to purchase. Lie and answer "no', and you may not pass the NICS background check, which may have record of your mental illness if you have ever been committed to a state run facility."

Now, if we want to make improvements to who/what gets reported to NICS, I'm all for it. Load that data base up with all the pertinent information we can. When/if he gets adjudicated mentally defective, that info should be added to NICS. If he has already purchased, or been authorized to purchase, firearms the addition of new information into NICS should pop a flag indicating that he had previously passed a NICS check and might possess firearms.

Sounds good. So how do they go about confiscating them?

Get a warrant and go get them.

Should be easy if he's in a padded room somewhere.

They don't always keep them locked up.  Like happened in this case. The only way would be a system where the mental health workers could cross reference a gun registry. Which last I checked, doesn't exist.

Don't see how that would change anything. He still would've been let out, right?

We don't need a gun registry. Like I said earlier, if/when it is determined that he's a nutjob we need to enter that info into NICS. When that happens it should pop a flag if he had previously passed a NICS check. Indicating the possibility that he possesses firearms.

The "I" in NICS stands for Instant. The moment the info gets added to NICS, we would know instantly that he had previously passed the check and therefore probably has a gun somewhere. Get a warrant and go get it/them.
