More Gay special laws...or not?

A gay couple in MD had a baby from a surrogate in Canada. The rub?  The U.S. doesn't consider the baby to be an American citizen because it was born abroad via surrogate.  This is no different than if a straight couple had a baby via foreign surrogate.  Gays are suing.  Thoughts?

If not born in the states and neither the egg or sperm are from Americans, then they baby is not American...

To be clear, the sperm is from one of the fathers, BUT he has not been an American citizen long enough (at least 5 years)to father a child in another country and have that child be an instant citizen.

Still seems pretty cut-and-dry to not being an American baby IMO...

I think the straight/gay litmus test holds.  There is no different treatment here.
