The U.S. doesn't consider the baby to be an American citizen because it was born abroad via surrogate. This is no different than if a straight couple had a baby via foreign surrogate. Gays are suing. To be clear, the sperm is from one of the fathers, BUT he has not been an American citizen long enough (at least 5 years)to father a child in another country and have that child be an instant citizen. 1 Share this post Link to post Share on other sites
