Texas, New Mexico, Oklahoma, North Dakota, etc are all drilling on private property and the federal lease ban does not effect these states and this is where fracking occurs. However, it is all political gesturing. The federal ban on new leases will have no effect because Trump approved all leases out 10 years and by then a republican will take office again.
