Donald Trump has sued E. Jean Carroll for defamation after a jury found he sexually abused the former magazine columnist and defamed her.

In a counter claim filed Tuesday night, Trump alleges that Carroll defamed him when she appeared on CNN the morning after the jury awarded her $5 million in damages. Carroll was asked about the verdict finding Trump sexually abused Carroll but did not rape her as she alleged. Carroll said, “Oh, yes he did.”

n response to the new claim, Carroll’s lawyer Roberta Kaplan said in a statement, “Donald Trump again argues, contrary to both logic and fact, that he was exonerated by a jury that found that he sexually abused E. Jean Carroll.”

She added, “Trump’s filing is thus nothing more than his latest effort to delay accountability for what a jury has already found to be his defamation of E. Jean Carroll. But whether he likes it or not, that accountability is coming very soon.

The counter claim is the latest legal salvo in a multi-year legal battle between Trump and Carroll. Carroll first sued Trump for defamation in 2019 after he denied her allegation that he raped her in the mid-1990s in the dressing room of Bergdorf Goodman. Trump said he didn’t know Carroll and that she wasn’t his type.

Do you ever get anything right? She did not do that, it was the jury convicted on the lesser charge of sexual abuse.

Right.  And the day after that she went on national media and said it was rape.  Sounds like a pretty clear case of defamation to me.  :dunno:

That actually crossed my mind...but maybe then Trump would have to admit to assault to make that case.  We are definitely getting into the legal weeds though now.

I don't think he'd have to admit anything.  Whether she's accusing him of something he didn't do at all, or something more severe than he was convicted of, it's defamation.  And with the jury verdict clearing him of rape she has no defense.  She KNEW he had not committed rape.

In 2016, Trump got around some of his scandals with women because Bill Clinton was seen as infinitely worse. Trump was a "chauvinist pig" with a loudmouth. And he appeared to essentially hire and payoff women who were probably being paid for sex. But Clinton was seen as a pure rapist who got away with it all and Hillary enabled it. 

For 2024, if Team Blue is committed to replacing Biden with Newsom, they have to neutralize the scandal of Newsom sleeping with female staffers. Newsom's main appeal is he gets votes from middle aged women across the entire spectrum ( they think he's good looking and yes it matters unfortunately)  Newsom cheating on his first wife with the then-wife of his "best friend" and campaign manager is bad enough. But to keep doing it in current times will drive away those valuable suburban women voters. 

Unless the "narrative" is that Newsom is just a cheater but Trump is a rapist. That's the DNC's angle here. 

The problem of course is Middle America won't vote for Newsom. They just won't. Also Team Blue will try to force a minority woman into VPOTUS. Which will only enrage the hard line black vote. ( The Party of "identity politics" will make a gay black women of some fashion bend the knee to the archetype "Ken Doll" of politics?) Or they can try Buttigieg as VPOTUS, which will enrage the White Evangelical vote.

This has legs. As witnessed here by the libtarded, they and most people don’t know the difference between sexual assault and sexual battery. Seeing as she amended her complaint from assault to battery, sue can’t claim ignorance. She knows the difference, because witnessed by the fact she amended her complaint.

Not to argue this to death, she KNEW he was not convicted of rape. Only 2 people KNOW what he did or didn't do. 

We'll see how it goes at trial, it will be definitely interesting to see whether she crossed the line or not.

It's was a civil trial, the jury never cleared him of rape.

Despite Carroll’s claims that Trump had raped her, they noted, the jury stopped short of saying he committed that particular offense. Instead, jurors opted for a second option: sexual abuse.

“This was a rape claim, this was a rape case all along, and the jury rejected that — made other findings,” his lawyer, Joe Tacopina, said outside the courthouse.

A judge has now clarified that this is basically a legal distinction without a real-world difference. He says that what the jury found Trump did was in fact rape, as commonly understood.

The filing from Judge Lewis A. Kaplan came as Trump’s attorneys have sought a new trial and have argued that the jury’s $5 million verdict against Trump in the civil suit was excessive. The reason, they argue, is that sexual abuse could be as limited as the “groping” of a victim’s breasts.

Kaplan roundly rejected Trump’s motion Tuesday, calling that argument “entirely unpersuasive.”

“The finding that Ms. Carroll failed to prove that she was ‘raped’ within the meaning of the New York Penal Law does not mean that she failed to prove that Mr. Trump ‘raped’ her as many people commonly understand the word ‘rape,’ ” Kaplan wrote.

He added: “Indeed, as the evidence at trial recounted below makes clear, the jury found that Mr. Trump in fact did exactly that.”

And aren't there something like 23 other women claming that Trump also sexualy assaulted them?

And no, I thought OJ was guilty and that Mark Fuhrman framed a guilty man.
