supermike80 Posted June 5, 2025 Posted June 5, 2025 So it seems Biden may be admitting there was an autopen used for some of his signatures. He is coming out claiming "I made the decisions" That to me says there was an autopen used and it is going to come out. The question is....What is the legality here? Is it illegal to use an autopen if Biden says he approved all the things that were signed? Is this a big nothing burger? Quote
Ron_Artest Posted June 5, 2025 Posted June 5, 2025 All presidents have used autopen. Obama used it to sign a Patriot Act extension and was deemed legal though never challenged in court. Biden's use of the autopen is likely legal as well but I have no doubts that Trump will find a judge that will rule it as illegal setting up for appeals and ultimately the supreme court. It's a colossal waste of time, money and effort by a broken man who will never get over his 2020 election loss and has made it his last dying mission to take revenge on anything and everyone involved in his defeat. 1 1 Quote
Strike Posted June 5, 2025 Posted June 5, 2025 His use of autopen is not disputed. Whether HE was the one using it and they were his decisions to use it is. Quote

Yep. This is the crux of the issue here. This seems like members of the junta that were actually running the country were using it for their own benefit and hiding behind Biden. I have ZERO doubt that Biden had no idea what he was doing and/or signing. In fact, to me, this calls in questions numerous other orders and not just the pardons. Quote

Well if that is the case, I doubt that will ever come to light. Biden has said he approved all of the signatures. And that's a he said she said situation that has no end. But are autopen pardons not technically legal? I am asking cause I don't honestly know. Quote

Never come before a judge, but laws and bills have been signed by it. George W. Bush asked the DOJ about it, so for whatever that is worth: President George W. Bush asked the Justice Department in 2005 if it was constitutional to use an autopen to sign a bill, with the department concluding that "the president need not personally perform the physical act of affixing his signature to a bill he approves and decides to sign in order for the bill to become law. Any signature or mark (yes one can still make their mark) is legal and fully binding if it is commonly used and acknowledged as one's own. That is the basis of the e-signature industry. Even before that, however, and before autopens, signature stamps routinely and commonly used and acknowledged were every bit as good as signatures. There is nothing in the Constitution nor Federal laws or regulations to say otherwise. The thing with Biden is not that it was used, but whether he knew it was being used so he could acknowledge the obligations of his signature. If aids were using it and Biden was uanble to understand what was being signed, or if aids misrepresented what was being signed then there is a problem. Quote

SaintsInDome2006 Posted March 4 Posted March 4 Bondi DOJ tried & tried to make a legal case on “***Autopen!!!” But they couldnt. Quote
SaintsInDome2006 Posted March 4 Posted March 4 >>> Justice Dept., Under Pressure From Trump, Fails to Build Autopen Case Against Biden Prosecutors in the U.S. attorney’s office in Washington were unable to build a case, underscoring the department’s increasing inability to follow through on the president’s desire to indict his rivals. The Justice Department, in the wake of calls by President Trump to criminally investigate former President Joseph R. Biden Jr., scrutinized whether Mr. Biden and his aides broke the law in using the autopen to sign presidential documents, but was ultimately unable to move forward with making a case, according to three people briefed on the matter. The department’s failure to build a criminal case against Mr. Biden and his aides is the latest example of its increasing inability to follow through on Mr. Trump’s demands and bring indictments against those he wants to be criminally targeted. Some of those cases were rejected by grand juries, some were rejected by judges and some, like the autopen case, were abandoned by prosecutors. But the fact that prosecutors even pursued the matter to begin with reflects the degree to which Mr. Trump has sought to use the levers of government to undermine Mr. Biden’s presidency by seizing on an unsubstantiated theory: that the pardons Mr. Biden issued in his final months in office were invalid because he did not have the mental capacity to consent to them. The autopen investigation was led by the U.S. attorney’s office in Washington, which is run by a longtime Trump ally, Jeanine Pirro. The inquiry was quietly shelved in recent months, around the time that prosecutors under Ms. Pirro sought and failed to secure an indictment in a different case: one against six Democratic lawmakers who posted a video in the fall that enraged Mr. Trump by reminding active-duty members of the military and intelligence community that they were obligated to refuse to follow illegal orders. In that case, a grand jury refused to issue an indictment, a once incredibly rare action in the federal court system, but one that has become more common as the Trump administration pushes the limits of the criminal justice system. In both the autopen and lawmakers’ video cases, veteran prosecutors were skeptical from the outset that there was anything close to sufficient evidence to justify criminal charges, according to people familiar with the matter.<<< Quote
