It doesn't work that way. Under The Constitution everyone in this country, legally or illegally, citizens or non-citizens are still entitled to Due Process under the law.

And you want to be technical, voters in the Democratic Party did select Kamala. Joe and her were both on the ballot in the primaries - and that is why the POTUS nominee and their running mate are both included, in case something happens to the nominee before or after the convention.

Obviously with the National Guard or US Army Troops (and SCOTUS says he can do that because as POTUS he is above the law).
