It would be if Trump or whoever is POTUS called it an official act, as according to SCOTUS the President has absolute immunity. Who's going to stop him if he suspends the 2028 elections? Not the Senate or a Republican controlled house. Probably not SCOTUS who put the actions of POTUS above the law. -
