I won’t care if Deadspin does end up getting sued and loses. But based on my memory of the article from a week ago, the complaint was that the NFL allows people to dress like that at games and that FOX took a camera angle that made it look like blackface, not that the kid was himself a racist. Hopefully Deadspin pulls the article and issues an apology.

It will be really hard to prove liable in court. No one sane is going to argue that putting a 9 y/o’s face under that headline was responsible.

They’re threatening legal action if the article isn’t retracted with an apology, not actually suing yet. Libel is really hard to prove and Deadspin would probably argue that they called the kid’s outfit racist, which is a matter of opinion, vs calling him racist. I can’t blame the folks for lawyering up and trying to get a retraction.
