  7. At least 40 U.S. veterans have died waiting for medical appointments at Phoenix Veterans Affairs Health Care system including many placed on a secret waiting list. The list was part of a complex cost-cutting scheme set up by Veterans Affairs managers in Phoenix aiming to hide the fact that between 1,400 and 1,600 sick veterans were forced to wait up to 21 months to see a doctor, according to whistle-blowing retired top VA doctor and high-level sources. Internal emails reveal managers at Arizonas VA hospital knew about the practice and even condoned it. Retiring Dr. Sam Foote, who spent 24 years with the VA system, told CNN that the Phoenix VA worked off two patient appointment lists. The "official" list shows the VA was offering timely appointments within 14 to 30 days. Foote called this a sham list because there was another secret document where waits where much longer. "The scheme was deliberately put in place to avoid the VA's own internal rules. They developed the secret waiting list, he said. According to Foote, the elaborate plans involved shredding evidence to hide the long list, with VA officials instructing staff to not make veterans appointments in the computer system.   9. Three Secret Service agents on President Obama's detail were sent home from the Netherlands after apparently spending a night out drinking in Amsterdam ahead of the president's arrival Monday. Secret Service spokesman Ed Donovan told Fox News that the agents had been sent home "for disciplinary reasons" and had been placed on administrative leave pending an investigation. Fox News is told top officials are furious this happened in the wake of the 2012 prostitution scandal in Colombia.     President Obama will push to "fully reverse" the so-called sequester cuts as part of his upcoming budget plan, a proposal likely to anger fiscal conservatives who want to see spending limits in place. The across-the-board cuts, agreed to by both parties, have been in effect since 2013, after lawmakers were unable to produce a more strategic deficit-cutting plan. Members of both parties have problems with the cuts, which indiscriminately affect both domestic and defense programs. But according to a White House official, Obama plans to call for a complete overhaul when he addresses the House Democratic Caucus in Philadelphia Thursday evening. BOSTON A federal appeals court on Friday upheld a judge's ruling granting a taxpayer-funded sex change operation for a transgender inmate serving a life sentence for a murder conviction, saying receiving medically necessary treatment is a constitutional right that must be protected "even if that treatment strikes some as odd or unorthodox." Newly released emails on the Benghazi terror attack suggest a senior White House aide played a central role in preparing former U.N. ambassador Susan Rice for her controversial Sunday show appearances -- where she wrongly blamed protests over an Internet video. More than 100 pages of documents were released to the conservative watchdog group Judicial Watch as part of a Freedom of Information Act lawsuit. Among them was a Sept. 14, 2012, email from Ben Rhodes, an assistant to the president and deputy national security adviser for strategic communications. The Rhodes email, with the subject line: "RE: PREP Call with Susan: Saturday at 4:00 pm ET," was sent to a dozen members of the administration's inner circle, including key members of the White House communications team such as Press Secretary Jay Carney. In the email, Rhodes specifically draws attention to the anti-Islam Internet video, without distinguishing whether the Benghazi attack was different from protests elsewhere. The email lists the following two goals, among others: "To underscore that these protests are rooted in an Internet video, and not a broader failure of policy." State elections officials in North Carolina are investigating hundreds of cases of potential voter fraud after identifying thousands of registered voters with personal information matching those of voters who voted in other states in 2012. Elections Director Kim Strach told state lawmakers at an oversight hearing Wednesday that her staff has identified 765 registered North Carolina voters who appear to have cast ballots in two states during the 2012 presidential election. Strach said the first names, last names, birthdates and last four digits of their Social Security numbers appear to match information for voters in another state.     The Massachusetts Department of Children and Families took emergency custody of Justina on Valentines Day 2013 after doctors at Tufts Medical Center, which had been treating her for a rare condition, and doctors as Boston Childrens Hospital, clashed over the cause of her medical problems, which included difficulty eating and walking. At Tufts, Justina had been treated for mitochondrial disease, a group of rare genetic disorders affecting cellular energy production. When Justina began experiencing some gastrointestinal problems, the Tufts doctor treating her, Dr. Mark Korson, wanted the girl to visit Dr. Alejandro Flores at Boston Children's Hospital, according to the family's attorney, Phil Moran. Flores had treated Justina in the past, Moran said, and Korson thought it beneficial for the teen to see a gastroenterologist. What happened next was a "tragic nightmare" for Justina and her family, Moran told FoxNews.com. Justina was taken by ambulance to Boston Children's Hospital because she was in a wheelchair at the time and a heavy snow storm was blanketing the region. Because she arrived by ambulance, she was taken directly into the hospital's emergency room, where a "resident refused to send her to Dr. Flores" and, "declared this was his case," according to Moran. He said the unnamed resident then called upon a psychologist who diagnosed Justina with somatoform disorder -- a mental condition in which a patient experiences symptoms that are real but have no physical or biological explanation. Justina was diagnosed with the disorder "within 25 minutes," Moran claims. The Pelletier family rejected the new psychiatric diagnosis and wanted to bring Justina back to Tufts, Moran said. He claims the hospital tried to force the girl's parents to sign papers preventing them from seeking another opinion. After tempers flared between the Pelletiers and staff at Boston Children's, the hospital notified the state that it suspected the parents of medical child abuse. The girl was kept at Boston Childrens psychiatric ward for nearly a year, but was then slated to be transferred to another state facility. Johnston said the family, which vented its anger in various media interviews, hampered efforts to have her placed as near them as possible. She is currently being held at the Wayside Youth and Family Support Network facility in Framingham, Mass. Lou Pelletier told Fox News it shouldn't surprise anyone that he was left angry after seeing his child taken away. "There's never been a complaint about the Pelletier family regarding our daughter, our family, prior to Boston Children's Hospital getting involved," Pelletier said. "The complaints have been when DCF decided we didn't smile rightly at them or do whatever." He said Johnson ignored the testimony of his daughter's original doctors, who stand by the diagnosis of mitochondrial disease. In the more than a year since the ordeal began, the Pelletiers have only been allowed hourly visits each week with their daughter, whose condition, they say, has deteriorated. She has not attended school or church since the family lost custody of her, he said. "Tufts was working fine with her, diagnosed medically, going to school, ice skating and doing all those things," Lou Pelletier said. "Look at her then and look at her now." Justina's older sister, Jennifer, told Fox News her parents are loving and supportive. Watching her sister's condition worsen in the hands of Massachusetts officials has been frightening, she said. "If something happens to my sister under their care, she's not just going to be another number in the system," Jennifer said. "It's insane." Johnston's ruling leaves it up to the state Department of Children and Families to decide whether or when Justina should be returned to her family, and leaves open the possibility the girl will be in state care until she turns 18. The judge is expected revisit the decision to award permanent custody in a follow-up court hearing on May 25.   16. There has reportedly been a shooting at a high school near Portland, Oregon. Police in Troutdale, Oregon confirmed that there has been a shooting at Reynolds High School, but had no other information at this time. Someone reported the shooting to police at 8 a.m. CBS News is reporting there are injuries. At this time, it's unclear whether there's a suspect in custody. Police are treating this as an active shooting situation. The school is in a lockdown. Fox 12 in Oregon noted that it's finals week at Reynolds High and some students didn't have to be at the school until 11 a.m. A Life Flight helicopter has reportedly been dispatched to the area.   17. A 2-year-old Utah boy died over the weekend when a 6-foot-tall dolphin statue outside a San Francisco fine art and antique store fell on top of him, authorities said Monday. Police said Kayson Shelton was attempting to climb the statue at the Majestic Gallery on Jefferson Street despite attempts by the boy's older sister to stop him. Witnesses told KTVU that Kayson collapsed shortly after the Sheltons left the store. The boy was taken to San Francisco General Hospital, where he was pronounced dead of internal injuries. "This is an unfortunate and tragic incident," the Majestic's owners said in a statement. "Majestic Collection is and has been co-operating with all investigative agencies. Our hearts and prayers are with the family." Police said that the Gallery had turned over surveillance video of the incident. San Francisco Police spokesman Officer Gordon Shyy told KTVU that the gallery's owner had been cited for violating a Port Authority code that mandates stores on Fisherman's Wharf to keep merchandise behind a line painted on the sidewalk.   18. STRATFORD, Conn. The mother of an 11-year-old Connecticut boy has been arrested after police say her son brought a grenade to school for a show and tell related to World War II lessons. Lisa Miguel of Stratford was charged with risk of injury to a minor, reckless endangerment and illegal possession of an explosive. Stratford Academy was placed on lockdown Friday. Students were sent to the back of the school until a bomb squad determined the grenade was a simulator used for training. The 44-year-old Miguel didn't immediately return a message Tuesday seeking comment. Police say she told them the grenade had been a gift from her father, a war veteran, who had told her it was a dud. The flood of illegal immigrants -- particularly children -- crossing into the U.S. along the southern border is at a "crisis" level, creating a humanitarian emergency that both immigration officials and lawmakers are putting at the feet of the Obama administration. Arizona Gov. Jan Brewer called the overload a "crisis of the federal government's creation." Sen. Jeff Sessions, R-Ala., who for years has been warnings that the administration's easing of immigration enforcement would create a crisis along the border, said: "President Obama is responsible for this calamity." Recriminations are flying as state and federal officials grapple with a surge in illegal immigrant children -- some accompanied, some not -- flowing into Texas. With resources there over-burdened, many of the children are being sent to Arizona, in turn overwhelming resources in that state. Arizona officials say they are now rushing federal supplies to a makeshift holding center in Nogales, as it runs low on the basics. But some are warning that the administration, rather than tightening enforcement in response, is continuing on the same path of steadily easing off immigration rules. "The rising crisis at the border is the direct and predictable result of actions taken by President Obama," Sessions said, adding that "only by declaring to the world that our border is no longer open -- and that the law will be restored -- can this emergency be stopped." Some of those warnings are coming from inside the administration. According to portions of a memo obtained by Fox News, an official with Customs and Border Protection wrote late last month that current policies are serving as an incentive for more to cross. "If the U.S. government fails to deliver adequate consequences to deter aliens from attempting to illegally enter the U.S., the result will be an even greater increase in the rate of recidivism and first-time illicit entries," Border Patrol Deputy Chief Ronald D. Vitiello wrote in the May 30 memo. Among the policies that allegedly are creating a magnet for illegal immigrants is what's known as Deferred Action for Childhood Arrivals. The unilateral policy in 2012 allowed some illegal immigrants who came to the U.S. as children to defer deportation -- among other criteria, they must have come to the U.S. before they were 16 years old, be younger than 31 on June 15, 2012, and have been in the country since at least June 15, 2007, and have no criminal history. The administration extended that program earlier this month, allowing the immigrants to apply for protection from deportation for another two years. House Judiciary Committee Chairman Bob Goodlatte, R-Va., said in a statement that the extension and changes would "proactively invite fraud and abuse." In December, a U.S. District Court judge in Texas also claimed that federal agents were intercepting human smugglers transporting children at the U.S.-Mexico border -- and then delivering those children to illegal immigrant parents in the U.S. The situation is likely more complicated and involves more agencies than the order made it sound. It is a matter of public record that thousands of illegal immigrant children and teens are caught trying to enter the United States, and often sent to federally run care centers while their status is determined. Judge Andrew Hanen's order, though, claimed the Obama administration was engaging in a risky practice by delivering some children to their parents. He argued that the practice would only encourage more parents to have their children smuggled over the border, through operations often connected to the drug cartels.   20. Congressional budget scorekeepers said they can no longer measure the fiscal impact of many provisions of ObamaCare because the task is impossible. In a little-noticed footnote from April, the Congressional Budget Office (CBO) said it will continue to assess the effects of the law's exchange subsidies and the Medicaid expansion, while not tracking others. "The provisions that expand insurance coverage established entirely new programs or components of programs that can be isolated and reassessed," the office wrote. "In contrast, other provisions of the Affordable Care Act significantly modified existing federal programs and made changes to the Internal Revenue Code. "Isolating the incremental effects of those provisions on previously existing programs and revenues four years after enactment of the Affordable Care Act is not possible." The note came in the CBO's analysis of ObamaCare's insurance coverage provisions in April and was first reported Wednesday by Roll Call. It means that measuring the healthcare law's effect on the budget deficit will be much more difficult, if not impossible. The CBO is normally the best source of information on bills' projected fiscal effects. Democrats designed the Affordable Care Act to reduce the deficit despite its massive expansion of healthcare coverage by producing savings over time in programs like Medicare. The law also includes a variety of taxes and fees to raise revenue, some of which the CBO suggested it could no longer analyze.
