Alina Habba Resigns as New Jersey’s Top Prosecutor

Alina Habba, a Trump Loyalist, Resigns as New Jersey’s Top Prosecutor

Alina Habba resigned as U.S. attorney in New Jersey on Monday after a panel of federal judges ruled last week that she was serving in the position unlawfully.

Ms. Habba will become a senior adviser to Attorney General Pam Bondi and will oversee U.S. attorneys across the country.

A former personal lawyer to President Trump, Ms. Habba began leading the New Jersey office in March. In July, when her tenure was expected to end, the Justice Department kept her in place through a series of complex maneuvers that led to immediate legal challenges.

Last week, the Court of Appeals for the Third Circuit ruled that Ms. Habba had been serving unlawfully, a challenge to her authority that could place precedent-setting limits on President Trump’s power to choose his own top federal prosecutors.

The court affirmed an earlier ruling that said the Justice Department could not indefinitely extend the tenure of interim U.S. attorneys who were neither confirmed by the Senate nor appointed by district trial court judges — the two conventional ways for being appointed to the role permanently.

“As a result of the Third Circuit’s ruling, and to protect the stability and integrity of the office which I love, I have decided to step down,” Ms. Habba wrote, adding: “But do not mistake compliance for surrender. This decision will not weaken the Justice Department and it will not weaken me.”

Ms. Bondi said Monday that the court’s ruling had “made it untenable” for Ms. Habba to run her office effectively, “with politicized judges pausing trials designed to bring violent criminals to justice.” 

Ms. Bondi pledged to appeal the Third Circuit’s decision, and said that if it were reversed, Ms. Habba would return to lead the New Jersey office.
