  4. I merely go by my own experience. That is not to say my experience has lead to perfect acumen on such matters but I did spend the majority of my career in both the state and federal criminal courts and I did work both sides of the aisle to regular success. Of one thing I am certain, the final outcome will not depend on my opinon or my advocacy as I will in no manner be involved in the appeal or in ruling thereupon.
  5. I believe otherwise. The Court did not do a good job protecting the record of its rulings, rulings which go directly against established precedent. The appeal will be, of course, a pyrrhic victory coming, as it will, long after the coming election.

  7. Reversible error is a legal concept. The jury, in my opinion, followed the law as instructed and evaluated the evidence as set before them. The legal question is whether they were instructed properly and whether the evidence before them was as should have been admitted by the court.
  8. One of several reversible errors in my opinion. By the time that discussion is had with an appellate court the election is likely to be long over.
  9. In the 1960's yours was a very minority opinion. Now it is the dominant opinion and is gaining steam and any state laws holding otherwise are, in my opinion, likely to be found unconstitutional if challenged.

  12. National trend has been to restore voting rights to felons. Use to be they lost them. Now the majority of states allow them to retain that right and thjose which don't generally only rescind that right during incarceration and any term of parole. My state, Colorado, has restored their voting rights.

  18. WE will find out soon enough. I tend to agree that this jury, with these instructions and the evidence admitted is going to convict. I could well be wrong, but that is what I foresee. I also foresee the verdict being overturned on appeal for any number of reasons but by then our history will already have been irreversibly effected.
  19. Well a hung jury is now off the table given reports. Has to be guilty or not guilty. I thought Trump's best chance was a hung jury but who can say.

  21. I fear hysterics from each side of the spectrum may behave very badly and potentially even violently upon a verdict. Folks seem very worked up and very much tribally aligned. I would just stay far away from the courthouse if I lived in New York.

  23. It has been a long, long time since law school for me. When I was there we learned, mostly tangentially, that two states were what was referred to as Field Code states, that is their intrinsic law was not based entirely upon english common law as is the case in most stes, but they had elements of french and even dutch law primarily procedurally. The First, Louisianna was strongly influenced by french prodcedure and the seond New York by french and dutch. Some of the procedures we are seeing here are, I presume, a result of that, but being admitterd in neither of those jurisdictions and the passage of time since my education I really cannot say. (Admitted in Minnesota, Wisconsin, Colorado, Wyoming, New Mexico and to the Federal Bar and provisionally admitted, pro hac vice to Virgina and Florida, now retired and I have relinquished my license so as to not have to keep up with CLE's.)
