The authority to create FEMA is in the Constitution. Congress passed the law establishing it & governing its operations. The executive branch executes that law. -

I have this theory that as the Trump2 administration scrapes every last piece of expertise & competence from government they’re just throwing their hands up & giving up on their legal obligations because they don’t know how to do things. For instance the use of the US Navy to do drug interdiction seems more logical when you realize who’s running DHS & DEA & ATF. They’re arguably just clueless so they just shift the responsibility rather than be accountable. -

I’m glad to discuss the presidential immunity elsewhere, it’s long & complex. However my point is up until summer of 2024 it was a completely unheard, unargued & ridiculed theory. So you may say oh this is ridiculous as well. I also dispute the 6-majority are strict constitutionalists, they are not IMO. And I’m not saying Trump will do this, I tend to agree more with Mike’s point further up about the Thiel-Vance faction demanding & getting a handoff as part of all this (& no doubt the Trump family will be handsomely compensated). I think that has more sway on the decision than (sadly) the constitution. -

Thank you for the response. I disagree. I think the Court that grew presidential immunity out of its elbow will either 1. Side with Trump, or 2. Delay things so long that it won’t matter. I’m not saying Trump will do this but IMO tge pathway is there. -
