Getting overturned doesn’t mean a lot. I mean if you just focked up on basic 101 stuff, then yeah, maybe. But a lot of the time it’s a new decision, or resolution of an open issue, or you get overturned by some crap panel on, say, the ninth circuit. Appellate judges are fallible too. Or hell, maybe the side that won just has sh1tty appellate counsel and they failed to “uphold” the ruling for the judge. So just saying oh this judge has been overturned X times is pretty irrelevant. You have to know why they were overturned in each specific case and then also know all the ins and outs of the appellate panel that overturned them, the relative quality of appellate counsel, and a whole bunch of other stuff too. Which almost no one is really qualified to judge and certainly not in any objective, quantifiable sense.

TBH, yes I think that probably is it. Certainly not a great outcome. But it wasn’t our doing— despite what the disgusting “blame America first” Putin-lovers may claim, it was Russia that forced this by taking Crimea and then invading the rest of Ukraine. Not me. Apparently unlike many people, I am capable of thinking about more than one thing at a time. Ukraine is still fighting an autocrat that is intent on undermining the United States and NATO (and has joined with China to do so), and which autocrat invaded their country. We should still support them. Now it does seem like things are at a stalemate and it’s fair to ask where this is going. I don’t think we should require Ukraine to cede all the territory Russia has taken or really even any of it (I would include Crimea in that as well). But what are the other options? That’s really for the generals and such to determine but I do think it’s a fair thing to examine at this point.
