    I've been wondering if it really is torridjoe. In support: he posts a shiot-ton of posts like he used to. His writing is coherent, which rules out 80% of the lefties here. To me the style seems similar enough: he would regularly take on an gang of conservatives by himself, bitterly clinging to obscure points. In opposition: his post count seems low. But I don't recall if we all got reset in the great Latin Pimp attack of 2006-ish?

    I appreciate your willingness to say the quiet part out loud. This is what I asked in my first comment to you -- to admit that this is all part of a strategy to stop the mean OMB from running for president. You wouldn't admit it then, but you have now. I remember you supporting a woman's right to abort a baby up until birth, because you believed that it was a woman's choice, and that that choice didn't change based on time. I didn't agree with your position, but I appreciated the consistency of it. You used to be a liberal, but now you are a machiavellian leftist.

    Thanks, I understand that. My point is that it seems like NY can magically call any misdemeanor a felony by claiming some loose tie to another crime that they never need to litigate. I'm not a lawyer, maybe this is normal and happens all the time in states across this great nation. But it seems wrong. Especially as an end-around to git the guy Bragg campaigned on gitting. Again, not a lawyer so I don't know. But unless it is firmly implanted in accepted law, I would think you can appeal something.

  18. Probably not. As to your original question: I don't know enough of the details to say if either should recuse himself, particularly about the case(s) themselves. I will say two things in general: 1. If a judge were to have some prejudice, it should err on the side of the defendant. 2. It is much easier to replace a trial judge than a SCOTUS justice.

    I feel like I'm in an Abbott and Costello skit... I believe that if you allege that a defendant committed a crime to further a second crime, that the defendant should be charged with that second crime, and the prosecution must prove that crime beyond a reasonable doubt. Otherwise, the defendant is denied due process. It will be interesting to see if this is argued on appeal.

  21. I asked you in your thread about Alito and Thomas if you thought Merchan should recuse himself. You never answered. Also it's polite to offer your opinion before asking it of someone else.
