That would depend on the relevant state and local laws and policies of the restaurant as long as said policy did not contradict the laws. Doing a quick search it looks like Minnesota law allows trans individuals to use the bathroom of the gender they identify with, so my answer to your question would be no.

I think a significant # of people will and should care if people being harassed for using the gender bathroom of their biological sex becomes a trend.
