Several of the things I said were possibilities turned out to be true. -

OK you got me, I thought we were talking about statements that they claimed in the indictment to have actual evidence of, not just claims that they might be making up (which you seem to acknowledge above is a possibility). But when you said the below you didn’t really leave open the possibility that they’re lying. I wouldn’t act all high and mighty though, you were wrong earlier when you claimed a second home rider meant you couldn’t rent the home out at all. That was very clearly incorrect. -

I’m not sure Halligan realizes the thing about the first year, as she says the “scheme” went through at least January 2024 -

The indictment doesn’t say she “never” used it for personal use, it said she filed tax “form(s)” reporting zero personal use days. It does not say which year or years that she filed those forms saying that. -

For the first year? Link? That is not in the indictment. -

What, do you think it’s definite that she rented it out for more than six months of the first year that she owned it? If it was a POS, she may have had to fix it up first anyway, which would still qualify as it being available for her personal use. -

I saw Saints talk about scenarios with Airbnb, I didn’t think he was necessarily saying that’s what he thought James did with the property. Any comment on the fact that there is an Airbnb listing at literally the exact intersection you named? -

That combined with if she rented it out for less than 6 months of the first year, then yup pretty sure she did. -

Maybe I missed but I don’t think anyone here was saying she used this house as an airbnb. Nonetheless, this one looks to be at Lafayette and Perrone. https://www.airbnb.com/l/QuMjxp1r -

It’s on the same street as a listed previous address of her niece that she later bought the other house for. For that reason, very reasonable to believe that she stayed there. -

If she rented it out for longer than 6 months of the first year, it looks like that would be breaking the law. -

Actually the second home rider also includes a caveat that it’s not illegal if you get approval from your lender in writing (so no, @SaintsInDome2006, just a phone call would not suffice). -

I will keep this post in mind for initial verdicts on future cases. -

Of course you’d side with the guy that refuses to read 3 pages that will answer his questions and confirm I’m correct. -

Yup. I’ve seen people bring up “TaX fRAuD!!” but she’s not being charged with tax fraud. -

Because you said you “gotta say there’s more.” If you don’t want to take my word for it that there’s not, you can find out for sure by reading it. -

Another lie because the main reason I started posting here was to discuss a topic that shouldn’t have been political, and I specifically tried to keep politics out of it. If you enjoy talking about financial issues, I think it would be in your best interest to read the indictment. It’s pretty short. But again, you are welcome to remain uninformed. -

Liar. I did not vigorously defend him, I said it was possible he was a fraudster very early on. For someone that “doesn’t care” about this topic, you’ve typed a lot of words about it this morning. But you are welcome to be uninformed, it’s a free country, for now. -

Then read the indictment. You could have done that in less time than it’s taken you to respond multiple times here. The part talking about the actual allegations is only 3 pages long, double spaced. https://www.documentcloud.org/documents/26184192-james-indictment/ -

I was looking into them, and was told by multiple lenders that I could call it a second home as long as I used it myself for one day, and could rent it out the rest. But as you alluded to elsewhere, even if you don’t, I think you can make an argument about if you intended to do so then something changed. -

That’s all there is, at least for this current indictment -

It says she indicated zero personal use days on a tax form or forms. It does not say what year or years that was. According to the second home rider, all that matters is the first year. -

Except we don’t know if she actually used it as she said she would, at least in the first year which is all that matters here -
