10 of the 11 Presidents who did not obtain an Electoral College majority served as President legally

Recommended Posts

Although 11 U.S. Presidents have occupied the office without receiving a majority of electoral college votes, 10 of these 11 legally served as President via laws stipulated in the Constitution and it's Amendments.

(1) Gerald Ford ascended to the Presidency without ever receiving a single electoral college vote running for President or VP.  Ford had been appointed VP when Spiro Agnew resigned in 1973, and became President in 1974 after Nixon was told he needed to resign or he would be impeached.

Ford was placed into office legally under the rules of the 25th Amendment.

In 1824, (2) Andrew Jackson received the most electoral college votes of all candidates and had the highest number of votes when the popular vote was tallied.   Due to multiple candidates, however, he had only received a plurality, rather than a majority, in the electoral college.   Following the 12th Amendment rules, the election then spilled over into 1825, and the House of Representatives voted and chose John Quincy Adams as President.

Per the 12th Amendment, this election in the House of Representatives was legal

Multiple Presidents have assumed the role after having been legally elected VP,  when the President was killed or died in office:

(3)  1841 - VP John Tyler (William Henry Harrison died of Pneumonia)
(4)  1850 - VP Millard Fillmore (Zachary Taylor died of food poisoning)
(5)  1865 - VP Andrew Jackson sworn in after Abraham Lincoln assassinated
(6)  1881 - VP Chester Arthur sworn in after James Garfield assassinated
(7)  1901 - VP Teddy Roosevelt sworn in after William McKinley assassinated
(8)  1923 - VP Calvin Coolidge sworn in after William Harding died of heart attack
(9)  1945 - VP Harry Truman sworn in after Franklin Roosevelt died of brain hemorrhage
(10) 1963 - VP Lyndon Johnson sworn in after the CIA arranged for Kennedy to be shot in Dallas

All of these were legal via Article II, Section 1, Clause 6 of the US Constitution

Only #11, Joe Biden, occupied the oval office without legally receiving a majority of the electoral college votes or ascending to the Presidency through other legal means.  After announcing that he had assembled "The most extensive and inclusive voter fraud organization in the history of American politics", his campaign and allied parties assembled a combination of new and unique mail-in ballot schemes, ballot harvesting, delayed vote counting, post-election vote curing, and loosened voter integrity laws in many states.

These changes resulted in between 15 and 20 million votes being counted for Biden's campaign in the 2020 presidential election that can't be proven to be affiliated with a legal voter.   Those votes and the voters they supposedly represented, disappeared in the subsequent presidential election of 2024.

Multiple lawsuits ensued between November of 2020 and Dec 31, 2020, in response to the outcomes achieved via the voter fraud organization reference by Biden.  Of the 21 cases that were accepted into any court, the attorney's representing Republican opponents of Biden prevailed in 14 of those 21 cases.  The majority of these cases were refused to be heard, however, with only a very few ever even being reviewed by the Supreme Court.

With armed guards stationed around barricades and fencing keeping the American public away from the activity, Biden spoke to a tiny crowd of supporters on Wednesday, January 20, 2021 and moved into the White House.

A historic first had been manufactured, and the office was occupied without a legal mechanism supporting the action, in violation of US Code Title 52, Subtitle II, Chapter 20511 Section (2).

I don't think Taylor is now believed to have died of food poisoning, supposedly there was some sort of dysentery generally affecting DC resulting from the fetid waters of the Potomac by the White House.

Makes sense, they don't call it the swamp for nothing.
