wiffleball 4,800 Posted November 30, 2007 Gonna be interesting to see how this one plays out. The article doesn't say that the dead men were armed, so I'm assuming they weren't. His attorney is full of shiit, but he's doing his job. The old dude can't just create a confrontation and kill these guys. And, the Texas law doesn't go so far as to say you can kill somebody trying to protect somebody ELSE's property. That'd be a pretty wild precedent to set. Sounds like the attorney is doing the only thing he can do - the 911 tapes are very clear, so he's got to exploit what isn't - the actual confrontation. Sounds like he's going to try and argue the old dude didn't intent to kill these guys, but when he confronted them, they threatened his life. That's gonna be a tough one to sell: Attorney: "Just because he went outside doesn't mean he went outside with the idea of shooting them," Client to 911 operator: "I'm not going to let them get away with it," "I'm gonna shoot. I'm gonna shoot." When you're recorded for 6 minutes being told NOT to shoot and you still repeatedly say that you intend to shoot, (and apparently to "kill" them)that's about as clear a case for premedititation as you can get. Best they can hope for is the Grand Jury. And hey, if it's a Pasadena GJ, they got one hell of a shot. Share this post Link to post Share on other sites
