Judge says press, public may view R. Kelly tape

Cook County Judge Vince Gaughan ruled against both prosecutors and defense lawyers for R&B superstar R. Kelly Thursday, saying he will not prevent members of the public at Kelly's child pornography trial from viewing the videotape that appears to show Kelly engaging in sex acts with a 14-year-old girl.

 

Yes, it might mean people are watching child pornography, but to make secret the heart of the prosecution case against Kelly might undermine the public's confidence in the jury's verdict, Gaughan said.

 

"This is the whole crux or linchpin of the case against Mr. Kelly," Gaughan said. "Without it, the case wouldn't exist." Adding that he did not want a "star chamber," the judge said, "The press is very important and can't be excluded."

 

R. Eugene Pincham, a former appellate justice who made his first appearance as part of Kelly's legal team Thursday, said after the hearing he was very surprised Gaughan would rule against something both sides agreed on.

 

The only issue on which the two sides disagreed was whether the press should be allowed to view the videotape. Prosecutors thought the press should see the video, while Kelly's lawyers would have excluded the press, allowing only jurors, the judge and lawyers to see and hear it.

 

'This is getting a little frustrating'

 

 

 

Lead prosecutor Shauna Boliker said showing the video in open court could victimize the girl -- who is now 21 -- all over again, though she may not realize it for years.

 

Gaughan asked Boliker whether the alleged victim -- who denies she is seen on the tape -- is going to testify. Boliker said prosecutors would not call her to the stand as part of their case. The defense could still call her as a witness or prosectors could call her as a rebuttal witness.

 

Gaughan has been pushing to set a trial date for the four-year-old case this summer and appeared exasperated when both sides said they needed more time to contact experts before committing to a trial date. "This is getting a little frustrating -- the work isn't getting done," he said
