huh, Hawaii? I am an engineer, is it cool to live there or does it start to suck pretty fast?

If you like pristine weather, beautiful women and the high cost of living, then it is cool to live here. :dunno:

Well then you should have all sorts of administrative remedies at your disposal. I suggest you look into them and at least suggest that you may take some sort of action. Just the possibility alone will make them all uncomfortable enough to back off.

Done! Pending my interview/interrogation with the investigator, I will seek further action. Either through HR for severance and a referral letter or get an attorney. :banana:

My advice here is to look into filing an administrative complaint alleging defamation of character. Bringing in the cops and all that seems very unusual, and it could be very damaging to your reputation. This was a small matter that should have been handled discreetly. You should've at least got a chance to explain yourself. Instead they went way over the top and have caused you injury as a result. You can use that as a basis to at least make them uncomfortable, although actually following through in filing the complaint may well be more trouble than its worth.

I go in Friday to talk to the HR department for the new job offer. We'll see what they are offering. :pointstosky:

Flash forward to the end of the day, the big boss comes in to my office and asks me to come with him to the conference room. I walk in the room and low and behold there are 2 cops and a few representatives from my place of employment, and the new hire who approached me in the morning. Long story short, they put me on administrative leave with pay until they finish their investigation into my "threatening" my supervisor. :blink: No charges, just admin. leave????

 

Why didn't you just roundhouse kick them all and jump out the window? :dunno:

Maybe you can do that when you go back and meet with HR and stuff. I bet that would generate far more hilarity than "threatening action against them".

The trouble with the lawsuit idea is that you must prove you have been harmed in some way. If you get a new job right away with similar pay and bene's that will be tough.

 

I would still make them think that you are getting ready to sue them to keep the checks coming as long as possible.

I understand that angle. But, if he gets another job right away, who has he been defamed to? The most he could get out of that angle is a gag order against the employer and minimal $. But, with the way HR is today, the only thing ER's will reveal is date's of employment and salary anyway (for fear of lawsuit). Sounds like he didn't have a bunch of friends there that he lost over this. None that would testify to it anyway.

 

I just don't see how he could prove any "damages" assuming he can procure equivalent employment. Now, if he could get a prospective ER to say they didn't hire because of what HR at former ER said, it' another story. But, good luck with that.

I went to my big boss and told him I was going to HR to file a complaint against his facilities staff and he told me not to, that he would handle it. Nothing was handled.

You did not answer my question. How can you prove you have been defamed? By who and to who? And, how has it hurt you?

 

Not dogging you here bro, what happened sounds like a turd storm on your face.  But, I know these things are very emotional and just trying to help you think with a clear head.

I have not been defamed yet, but this could affect my next job opportunity at some point.

I spoke with the investigator and everything went well..up until the last 5 mins or so. He read me the statement that the guy made and it was a f-bomb laced tirade that he said I said. I told the investigator that I did not say those things and now understand why police were called.

Based on there are no witnesses to the conversation, it is pretty much a he said/she said kinda thing. so they leave it up to the decision makers.

In the guys statement he said things like at no time was I angry, but I had this "steely" look in my eyes like I am some kind of raving lunatic. I was like WTF? In the very next statement he is talking about how he was trying to calm me down, yet the statement prior I was not angry??? Looks like a lawyer may be the way to go and let people a lot smarter then myself sort out the BS.
