ZeroTolerance 584 Posted June 25, 2009 http://news.yahoo.com/s/ap/us_supreme_court_strip_search File this under 'oh, you think?'. WASHINGTON – The Supreme Court ruled Thursday school officials violated an Arizona teenage girl rights by strip-searching her for prescription-strength ibuprofen, saying U.S. educators should not force children to remove their clothing unless student safety is at risk... The school's search of Redding's backpack and outer clothes was permissible, the court said. But the justices said that officials went too far when they asked to search her underwear. Now, the most entertaining part of the case... In a dissent, Justice Clarence Thomas found the search legal and said the court previously had given school officials "considerable leeway" under the Fourth Amendment in school settings. Officials had searched the girl's backpack and found nothing, Thomas said. "It was eminently reasonable to conclude the backpack was empty because Redding was secreting the pills in a place she thought no one would look," Thomas said. Thomas warned that the majority's decision could backfire. "Redding would not have been the first person to conceal pills in her undergarments," he said. "Nor will she be the last after today's decision, which announces the safest place to secrete contraband in school." Clarence Thomas, defender of the right to search student's underwear (for fairly frivolous reasons). Shocking. RLLD 4,275 Posted June 25, 2009 I would normally frown upon suing because it is so abused, but in this instance, i think its appropriate. That being said, isn't it the lawsuits that brought our enlightened educators to the place where they now behave like the Stazi?
Vikings4ever 568 Posted June 25, 2009 Good ruling. If they want the strip search, get the cops involved.

The Court also ruled that the school system was not financially liable for this.

The strip search was illegal and yet they can't be sued for the illegal search? That makes no focking sense. Im not big on taking people to court but for christs sake it seems like they are letting the school district off for doing something that they had to have known was not right in the first ###### place. titans&bucs&bearsohmy! 2,745 Posted June 25, 2009 Under Thomas' reasoning, if the schools were allowed to strip search students, and didn't find pills in their underwear, then it would be "eminiantly reasonable" to assume that they had the pills stuffed in a bodily orifice. So are school administrators allowed to start performing cavity searches of minors? If so, I think we found the job for GFIAFP!
