Indicting Trump for 'knowingly false statements' about election sets US on dangerous path

....Prosecutors will seek to criminalize false political claims. To bag Trump, they will have to bulldoze through the First Amendment and a line of Supreme Court cases.....Smith and his team have made history in the worst way by attempting to fully criminalize disinformation by seeking the incarceration for a politician on false claims made during and after an election.....The hatred for Trump is so all-encompassing that legal experts on the political left have ignored the chilling implications of this indictment. This complaint is based largely on statements that are protected under the First Amendment. It would eviscerate free speech and could allow the government to arrest those who are accused of spreading disinformation in elections....

....Special counsel Jack Smith speaks on Aug. 1, 2023, about the indictment against former President Donald Trump on conspiring to steal the 2020 election from President Joe Biden, including the insurrection at the U.S. Capitol on Jan. 6, 2021.....Smith is now showing the same abandon in pursuing Trump, including detailing his speech on Jan. 6, 2021, before the riot while omitting the line where Trump told his supporters to go to the U.S. Capitol to "peacefully" protest the certification....While the indictment acknowledges that candidates are allowed to make false statements, Smith proceeded to charge Trump for making "knowingly false statements....."

.....On the election claims, Smith declares that Trump "knew that they were false" because he was "notified repeatedly that his claims were untrue." The problem is that Trump had lawyers and others telling him that the claims were true. Smith is indicting Trump for believing his lawyers over his other advisers. Trump was wrong about 2020 election, but that doesn't mean he broke the law .....I criticized Trump's Jan. 6 speech while he was still giving it and wrote that his theory on the election and the certification challenge was unfounded. However, that does not make it a crime....

....Let's acknowledge that Trump was wrong. The election wasn't stolen. He lost, and Joe Biden won....But how do you prove legally that Trump truly didn't believe his false claims? And even if you can prove that Trump lied, how do you legally distinguish his falsehoods from the lies other political leaders have told over the years? When, in politics, does making a false statement cross the line into criminal behavior? Those are questions Smith and his team must answer in court, and ones that Trump's defense team is likely to raise....Instead, Smith will seek to criminalize false political claims. To bag Trump, he will have to bulldoze through the First Amendment and a line of Supreme Court cases. That's why this latest indictment of Trump isn't just wrong. It is reckless....

"Again, there's no excuse for his positions. There's no excuse for what he said. There's no excuse for anybody to support racism. There's no place for it in our league, but there's a very, very, very slippery slope.....But regardless of your background, regardless of the history they have, if we're taking something somebody said in their home and we're trying to turn it into something that leads to you being forced to divest property in any way, shape or form, that's not the United States of America. I don't want to be part of that.....You don't; there's no law against stupid....I'm the one guy who says don't force the stupid people to be quiet. I want to know who the morons are."  - Dallas Mavericks owner Mark Cuban on Donald Sterling.

Trump is an idiot. A total imbecile. But you can't just make up the law as you go a long. And Jack Smith can't just make up the law in the way he wants or just the way that Obama wants it done.

You don't stop someone like Trump by subverting the actual principles of law in this country. No matter how repugnant most people find Trump. You stop Trump with "More Democracy" Go win lots of elections and get the majorities you need to change the laws and load SCOTUS with your own people without court packing, to criminalize the things Trump has done through the established formal legal processes in this country. You win lots of elections by helping the basic material needs of every day working class Americans. Make their lives better and give their children hope and a future, so they want to come out and vote for you.

You don't defend actual democracy by gaming the system as much as possible with the weak "justification" that this is all needed to put down Trump for good. I find Trump to be totally exhausting and want him out of professional politics. But without process, real democratic processes at work, then our Republic will fall. And if it falls, all your children will inherit what exactly?

One day Trump will be gone. One way or another. But the legacy of this endless persecution, whether some of it might even be justified legally, will echo against actual freedom for generations to come.

DeSantis Calls Out Trump For Refusing To Sign GOP Loyalty Pledge: ‘It’s Not Just About You’

.....Florida Governor Ron DeSantis slammed former President Donald Trump for refusing to sign the Republican Party’s “Beat Biden Pledge” in which candidates state that they will support whoever wins the party’s presidential primary.....DeSantis, who trails only Trump in the GOP primary race with all the candidates polling in the low single digits, made the remarks while speaking to reporters in Iowa late this week after the former president said that he would not sign the pledge.....“I mean, you can’t, on the one hand, say that the country’s going in such a bad direction, which we all believe, and then, on the other hand, say you’re just going to take your ball and go home,” DeSantis said. “I’m happy to do that. I’ve voted Republican my whole life......And even though I’m confident we’ll be the nominee, at the end of the day, you respect the judgment of how this works out, and you don’t take your ball and go home,” he continued. “It’s not just about you. It’s about a larger mission that we have to accomplish for Americans.....”

.....Trump told Eric Bolling on Newsmax this week that one of the “problems” he has with the upcoming Republican debate was having to sign the pledge to get on stage.....“I wouldn’t sign the pledge,” ....Trump said. “Why would I sign a pledge? There are people on there that I wouldn’t have......I can name three or four people that I wouldn’t support for president....So right there, there’s a problem right there. There’s a problem.”......The “Beat Biden Pledge” that the candidates have to sign states in-part: “Additionally, I affirm that if I do not win the 2024 Republican nomination for President of the United States, I will honor the will of the primary voters and support the nominee in order to save our country and beat Joe Biden.....I further pledge that I will not seek to run as an independent or write-in candidate nor will I seek or accept the nomination for president of any other party.....”

.......The Daily Wire reached out to the Republican National Committee (RNC) to ask if Trump would be allowed to participate in the debates if he did not sign the pledge, and a spokesperson responded by pointing to a statement that chairwoman Ronna McDaniel made several weeks ago.....“Everybody has to sign the beat Biden pledge, everybody, it’s across the board, the rules aren’t changing, we’ve been very vocal with them...It’s not just the pledge, not just a piece of paper. Intent is going to be part of it, too. I think the debate committee is going to meet, and they don’t want somebody saying, ‘I’m blatantly lying.’ You have to say I’m going to support the nominee whomever the voters choose.....”

I agree with Trump here on a specific point, but not in line for his own self motives. There's really a lot to despise about The Big Cheeto. And I clearly want him out of professional politics. I also would never want to see any of the current Democratic contenders take POTUS 2024. That being said, despite Trump doing this for his own political strategy ( i.e. he'd clearly sign it if it was to his advantage to do so), I don't agree with signing "oaths" to commit to support someone that you clearly don't want to support. There's no incentive for Trump to debate, because he'd get hit hard on all his scandals. Also since he's the presumptive favorite, it's not in the RNC's interests to have him debate, since each hit against him can be used later in the 2020 general election. However to disbar a former POTUS running again from debating is unsavory. The DNC did that with Tulsi Gabbard in 2020. Literally changed the rules to get rid of her. I don't agree with that and I don't agree with this.

The American people deserve to hear from ALL contenders. Everyone should have their records, scandals and feet held to the fire in public and in the national daily media cycle.

This is clearly disgusting coordinated gamesmanship between Ronna McDaniel and Donald Trump. This is so Trump won't have to debate and so the RNC and McDaniel can save some face in public. But none of it is actually good for the American people.

David Pakman is an idiot. But the RNC and Trump have gone into the tedious corporate establishment politics zone so far here that they've actually made him seem reasonable. How exhausting and partisan do you have to get to allow Pakman to appear almost civil?  That should be a litmus test on the pure chaos involved for 2024. The American people deserve better than that gutless lying coward in Joe Biden and this self absorbed imbecile in Donald Trump. Is there any greater advertisement than that to encourage all Americans to just stop paying their taxes?  I mean this should disgust all Americans when they get their monthly paystub and see all the taxes taken out and realize it's going to be set on fire by one of these two grifter nimrods.

There are very few absolutes in the political world. The best laid plans can fail, half baked, thrown together policy can turn out well.

One absolute is DJT is not for for public office, he’s a menace and cannot be trusted with the responsibility.

Bad Biden polls stoke third-party angst for Democrats

New polls showing President Biden tied or trailing several GOP presidential candidates and deep concerns among voters over his age are stoking Democratic angst about third-party candidates “stealing” a victory in November 2024...Democrats have long been worried that in a close race, a third-party candidate could be the difference between winning and defeat in hard-fought states such as Georgia, Arizona, Wisconsin or even Florida

But the new polling is exacerbating unease that liberal candidate Cornel West or a centrist contender backed by No Labels could end up being spoilers for Biden. Groups on the left are among those expressing discontentment, arguing that the only candidates who will have a chance to actually win the White House are Biden and the eventual Republican nominee.....According to the survey, a whopping 67 percent of voters who identify as Democrats or lean left said that they’d prefer someone else as the nominee. At the same time, just as many voters believe Biden will ultimately nab the nomination, creating a difficult position for those helping to prop up an unpopular candidate.

Another data point also signals a potential issue: Biden is in close contention not only with former President Trump but with lesser-known candidates like former South Carolina Gov. Nikki Haley, who led him by several points. Other polls separately show deep dissatisfaction over Biden’s age, with the majority of voters in recent Wall Street Journal and Associated Press/NORC surveys saying he’s too old to seek a second term in office.....“The CNN poll reinforces a truth we have known for a long time now at No Labels: most Americans do not want a rematch of the 2020 election,” Clancy told The Hill in a statement. “There’s growing enthusiasm for another choice who can bridge the partisan divide that is tearing our country apart.”

Little Enthusiasm for 2024 Front-Runners

....There is not a lot of enthusiasm for either President Joe Biden or former President Donald Trump becoming the major party nominees in 2024. American voters are much more likely to see Biden as too old than say the same about Trump .....This has mainly come from a decline in the Democrat’s support among Black, Hispanic and Asian voters, while Trump has made some gains among this group.....Three-quarters (76%) of American voters agree that Biden is too old to effectively serve another term as president. Just under half (48%) say the same about Trump...Just 37% of voters express at least some enthusiasm about the possibility of Trump being the Republican nominee and 32% are enthusiastic about Biden getting the nod for the Democrats. Majorities are not at all enthusiastic about either Trump (52%) or Biden (53%) being at the top of their respective party tickets. Among independents, 35% are enthusiastic about having Trump as the GOP nominee and only 19% feel enthusiastic about Biden heading the Democratic ticket....Majorities, though, say they will not vote for either Biden (51% definitely not and 6% probably not) or Trump (48% definitely not and 8% probably not). These results mark a drop in Biden’s potential support since July (from 47% to 42% combined) while Trump’s support has ticked up slightly (from 40% to 43%). Biden’s decline is due mainly to a significant slip in support among Black, Latino, and Asian voters (from 63% definitely or probably in July to 47% now). Trump has picked up about half of that number (going from 23% among voters of color in July to 33% now....

Dems pressure White House to change economic message

.....President Joe Biden placed a big bet that he could sell an improving economy under the banner of “Bidenomics.”......Three months later, some allied Democrats fear he’s made a serious misstep. Several top Biden allies have privately raised concerns about the phrase to the White House, according to two people familiar with the backchanneling......“With all due respect to the president, to the White House, this is not so much about them as it is the people who are benefiting by the policies that they came out and demanded,” said Horsford (D-Nev.). “We have to do a better job framing this not so much for one person — for the office of the presidency — but for the people.....”

......The rising cost of living remains a dominant theme in voters’ minds...... And so far, the Bidenomics drumbeat that began earlier this summer has yet to prove it can change their minds......“At this point, Bidenomics doesn’t really have strong answers to people’s biggest worries,” said Will Marshall, president of the Progressive Policy Institute, a centrist Democratic think tank. “.....But the administration’s case for patience is no longer masking the angst within the party that Bidenomics as a brand is falling flat — and perhaps is a microcosm of larger obstacles facing the coming campaign. An administration with accomplishments to sell has struggled to do so. A president who wants more credit for his work may, Democrats worry, be alienating voters by appearing insulated from their real life struggles....

.....In more than a dozen interviews across the party, Democrats offered various defenses and diagnoses of the administration’s messaging strategy and what may need to change. But nearly all acknowledged that the Bidenomics messaging blitz has failed to brighten voters’ view of the economy to date. Some now bemoan that the White House has tied itself so closely to a future economic trajectory .........“I’ve never understood why you would brand an economy in your name when the economy hasn’t fully recovered yet,” said Michael LaRosa, a former spokesperson for first lady Jill Biden. “People need to be able to see and feel an economy in their own personal bank accounts. And it doesn’t change no matter how loud you scream the economy is better.....”

.......“The place where economic confidence is faltering most is with the base of the Democratic Party — so it’s among young people, among African Americans and Latinos,” said Republican pollster Micah Roberts, a partner at Public Opinion Strategies who handled the economic questions in the bipartisan NBC poll. “There’s a disconnect between the two or three months of [the Bidenomics] campaign and what people are actually feeling.....”
