***Official Jack Smith Thread*** Smith referred to DOJ for misconduct probe, potential disbarment

Thought he had a thread dedicated to him, but all I could find was one on a DOJ report he submitted with his prosecution efforts.

Anyway...since he is on Trump's enemies target list, he is still in the news.

'Nothing like it has ever happened': Jack Smith rips DOJ’s politicization under Trump

Former special counsel Jack Smith has, for the first time, publicly defended the investigation he led into President Donald Trump, calling it “ludicrous” to suggest the work was politically motivated. He also criticized the current Department of Justice's actions.

“I worked in the department for years — Republican, Democrat, Republican. I was the acting U.S. attorney in the first Trump administration in Tennessee. Nothing like what we see now has ever gone on. This case in New York City, where the case against [NY Mayor Eric Adams] was dismissed in the hopes that he would support the president’s political agenda. I mean, just so you know, nothing like it has ever happened that I’ve ever heard of,” he said.

Smith made these remarks on October 8 during a panel discussion at University College London. They gained renewed attention Tuesday after being highlighted on MSNBC.

Meanwhile, Republicans on the House Judiciary Committee asked Smith Tuesday to sit for a hearing as part of a broader GOP push against Trump’s perceived opponents.

In a Tuesday letter, Rep. Jim Jordan (R‑OH) accused Smith’s Trump prosecutions of being “partisan and politically motivated.” His scrutiny deepened after reports that Smith’s team requested FBI analysis of the phone records of several Republican lawmakers during the Jan. 6 insurrection.

Smith, serving as special counsel, had indicted Trump on two fronts in 2023: one alleging efforts to overturn the 2020 election, and another accusing improper retention of classified documents at Mar‑a‑Lago.

He’s 100% right. 
 

One of the biggest lies by Trump, which all of the MAGA types seem to have bought into, is that the DOJ under Biden behaved badly, practiced lawfare, etc., and that in term justifies the crimes Trump is committing now. It’s total bullsh!t. 

In fact the only wrong that Biden’s DOJ committed was hesitating a couple of years before indicting Trump. They should have done so in 2021. Then he would be in jail, where he belongs, and we wouldn’t have the horrific situation in this country we face today. For this the blame has to go to Garland.

Jack Smith Faces New DOJ Scrutiny

Former special counsel Jack Smith has been formally referred to the Department of Justice’s Office of Professional Responsibility and two state bar panels for potential misconduct and disbarment, following revelations that his team secretly obtained phone metadata from nine Republican lawmakers during the Biden administration’s investigation into 2020 election interference, the New York Post first reported.

In a letter sent Friday to Attorney General Pam Bondi, led by Republican Tennessee Senator Marsha Blackburn, GOP lawmakers accused Smith of violating constitutional protections by subpoenaing telecom companies for call logs, including time, duration, recipient, and location, without clear legal justification.

Newsweek reached out to Blackburn's office via contact form and Smith's attorney via email for comment on Friday afternoon. The Department of Justice declined to comment.

You know, it’s funny. I think this happened because Jack Smith just did an interview where he made several statements:

- “The DOJ was my home for many, many years. That home is now on fire.”

- “In a society where the rule of law is eroding, you can have a situation where if you’re a Latino citizen… you can be stopped, detained, your liberty taken because of the color of your skin. Or maybe because you were speaking Spanish… whereas we all know that if you were white, that would never happen.” 

- “You do the right thing. You do it the right way. And you do it for the right reasons.” 
-  “Trust that has been won and earned over generations has been lost in weeks.”

- “Stand up to powerful people, and stand up for vulnerable people. Wherever and whenever you can.

- “As Martin Luther King Jr. reminded us, the arc of the moral universe is long, but it bends towards justice. But that arc doesn’t bend on its own. We need to make that happen.”

Still he hasn’t talked about the work he was doing, & in particular he’s never said what he thought Trump was ultimately doing with the classified documents he stole. This seems like a really foolish maneuver by the Trumpis as Smith could ultimately get to unfurl many of the things that DOJ rules have prevented him from saying.

It’s not clear what information about calls to or from the senators’ phones were obtained by the FBI, given the qualifier “limited” in the published document’s description. 

Importantly, the authorization for obtaining the records followed the approval of a subpoena by a grand jury, according to CBS News. In other words, this wasn’t the FBI simply digging into phone records. It was the government presenting a case to grand jurors that the records would be useful in their investigation and the jurors agreeing.<<

A lead member of former special counsel Jack Smith’s legal team is joining forces with former FBI Director James Comey, who faces charges of making a false statement to Congress and obstructing a congressional proceeding. 

Michael Dreeben will now beef up the legal team defending Comey, according to Politico.

Dreeben previously led Smith’s team in delivering arguments before the Supreme Court that Trump does not have absolute immunity for official acts. The debate around absolute immunity became an issue when Smith led the Biden DOJ’s election-interference prosecution against Trump. Trump argued the case was weaponized against him for political purposes, and he contended he was innocent of the DOJ’s charges that he sought to overturn the 2020 election during his actions on Jan. 6, 2021, due to an interpretation of the Constitution that he held absolute immunity for acts he committed as president.

This is like Wemby showing up for the 8th grade CYO basketball game. It’s a ridiculous mismatch, especially with Fitzgerald already on board.

I can’t imagine who would stand in for DOJ if & when their pursuit of Smith ends in an indictment. They still haven’t named anyone for the James case, which is ridiculous, an indictment of any kind & no one knows who the prosecutors are.

But to tie it in, every time Ed Martin, Miller & Co. do this the more it adds strength to the malicious prosecution motions which are coming in all these cases. The Leader’s statements only add weight to it all.
