Two gay men from Southern California hired a woman to be their surrogate so they could have a child. Weeks after the woman, Brittney Pearson, got pregnant she found out she had cancer and would need to undergo chemo treatment. In order to do that, she would need to give birth to the baby early. 25 weeks to be exact but it would give both her and the baby the best possible chance to live. However, the gay couple didn’t want that. Anything less than 38 weeks they didn’t want and didn’t want to pay her. They want the baby to be “immediately terminated”. Brittney refused to kill the child so they threatened legal action. When she offered to adopt the baby they demanded a death certificate. Surrogacy laws in Cali give no rights to her or the baby. She was able to push the baby out at 25 weeks but the purchasing couple had “ownership” of the child after birth. They ordered life saving care to be withheld. The baby boy died shortly after.
