I'd also be pissed off if there was dog sh!t all over the walkway, driveway, steps, etc (if it's really as bad as dave says it is). To get back at her, rent out the unit above her and take a piss on your "private" patio every day. Lastly, the argument that the patio is private property and a dog can sh!t and piss all over it is complete crap. I don't know if it will hold up in court, but for your condo association it is above and beyond common sense. Also, you said that the board already ruled that crapping on the patio is not allowed. They used to leave the dog out on their balcony unsupervised for hours at a time...sometimes overnight. Then, either the wind or the dog would knock a turd over the ledge and it would end up on my patio. Everyone has the same size balcony, except for me. I am on the "ground" floor, so I have a wood deck that has the same dimensions as the balconies above me. I also have a stone patio that extends out form my deck, which pretty much gives me 3X the amount of outdoor space as those who live above me. I have not had any new turds fall on my property in a while, as my "neighbor" lets the dog out, stands there and picks up the poop. Apparently, they think that this conforms to the directive from the board that they couldn't have their dog do its business out there anymore. Just b/c there are no turds falling my way doesn't mean this is acceptable IMO. First, the board made a decision and she should have to abide by it or offically appeal it. Second, as Blitzen pointed out, unless she's using some strong substance to clean the area it could become a health hazard. Share this post Link to post Share on other sites

Actually, we are really good friends w/the neighbors directly above us and below the pooper. They are totally with us. I CC them on all of the email I send and they too have submitted complaints to management about this. I have taken the lead on this for a few reasons: 1) I started complaining first when I was finding the poop on my patio. When it first started we really didn't understand the scope of it all. For example, we had no idea that they were leaving the dog out there overnight or that this was in place of ever walking the dog, rather than an isolated incident. 2) Because their balcony is the exact same size as the pooper's balcony, there isn't as much chance that anything (poop or rain/runoff) will end up on their balcony as there is that it will end up on my property. 3) I can be a bigger pain in the ass than he can. Find as many people who are as pissed as you and show up to the next board meeting....or at least show up in the manager's office. Enough of this email, face to face always works best. Work on getting a crowd together, that will really make it sink into Bill that "hey, this really IS a problem I should confront." When I first went to the pooper about this she was extremely standoffish. We had never met and when she answered her door, I introduced myself...while she just stood there w/her hands on her hips, not introducing herself back. Everything was like pulling teef. DaveBG: "Do you have a dog?" Pooper: "Yes" DaveBG: "Do you let it out on the balcony?" Pooper: "Yes" DaveBG: "Well, I live two floors down and have found dog poop on my patio." Pooper: "So?" You get the idea. The second time I complianed to management I did go to Bill's office for a face-to-face. I had to insist that he call her. He refused to come by and see the poop. So did the pooper, after she denied it was happening and claimed I made the whole story up. When I told Bill to invite her over to see it...or better yet to clean it up she started crying about how we were trying to make her get rid of her dog and how unfair we were being. Now, as for the poop that has been in other common areas, I'm not really sure if it's the same person/dog. First of all, the pooper would actually have to walk her dog for it to crap in the hallway. I don't think she does that. Second, one of the recent poop incidents happened on the hallway above the pooper. However, the problem that I have w/the pooper is emblematic of what's going on....namely, a lack of enforcement of the rules by Bill, which has emboldened those inconsiderate dog owners to continue to violate the rules. It has been getting increasingly worse in frequency. At first I was one of the only complainers. Now, I have other residents, including other dog owners in my building, telling me that they completely support me when I see them in the hall or the elevator.
