The Moz 71 Posted November 2, 2007 I got a ticket driving in this morning going through a construction zone ( 350 focking bucks ) . The limit is 45 I was clocked at 48 and the bastard pulls me over as if he had nothing better to do. Never in my life have i ever been pulled over for going less than at least 10 miles over. Talked to a few people this morning and some were saying if I fight it in court it would get thrown out because it was less than 5 miles over. phillybear 366 Posted November 2, 2007 Before it goes to trial, ask to see the documents for the radar gun. You have a legal right to view them. You want to see if it's been calibrated properly, etc. Since the paperwork is rarely kept up with and/or updated properly, you could argue that you were indeed going the speed limit. Wondering if anyone knows if there is any truth to this ? Prolly depends on your state and the way they treat construction zone violations. In AZ for instance, school zones are 15 with zero tolerance. I got a ticket once and went down to challenge. I ended up being sent to a magistrate to discuss. After the discussion, I was convinced not to challenge. And he "court ordered" me to traffic school which was a lot cheaper than the ticket. Perhaps you could try the same? But at the very least, the difference in the reading versus the speed limit is so small, it doesn't take into account margin for error. Request a jury trial. No jury will convict you of that, it will never make it that far. They will at LEAST offer deferred adjudication. Asst. DA's know know about d!ckhead cops.
