He is definitely in serious trouble. His attorney's were advised that he is a "target" of Jack Smith's investigation, which means he will be indicted unless his attorneys (when they met with Smith) were able to present a convincing case that it should not be done (which seems highly unlikely from what we have heard about this matter).

He won't do prison time, however. He has 24/7 Secret Service protection and the logistics of them being around him in that environment just won't work. He could however be sentenced to house arrest in Mar-a-Lago (or wherever) and wear an ankle bracelet with internet access cut off (which might be the harshest punishment of all).

Read the article. Drunk alcohol tests were not required by law in Delaware at that time after a fatal accident. And the article noted that it was believed in the local community that he had been drinking.

Definitive evidence in the form of a blood alcohol test as to the driver's sobriety doesn't exist, so it remains an unresolved question.

And Biden would not have been deliberately lying (which is the claim here) if he believed at the time, what was being said in the local community (even if it couldn't be proven)

Ruin a man’s life over hearsay. Any proof that was the rumor going around? It was a horrible rotten thing to do to a hard working family man. But most important, he was powerless, so Biden shite all over him for his own personal gain. No one punches down like this guy.

Occam's Razor is the simplest explanation but that doesn't mean that it is always the correct one. Yeah, they did their job, but in retrospect it was obviously incomplete.
