what constitutes a declaration of war?

America has been cheating for decades as to what constitutes a delcaration of war. See: Korea et al.

 

So now, we have China engaging in open cyber-warfare against us. Iran engaging in undelared, but proxy war against us, as well as NOKO.

 

So, when exactly do we declare war these days?

We don't. Legally, we haven't been in a war since WWII, as Congress has to declare war. See, then, Congress (the Senate actually) gets to weigh in on the end of the war, as they have to ratify the treaty. Presidents don't like that (See Woodrow Wilson getting his ass handed to him in the Senate over the League of Nations treaty after WWI), so they have just decided to never declare war.

 

Of course, after Viet Nam, Congress didn't like being end-arounded, so they passed the war powers act. Presidents claim it is unconstitutional, but nobody has ever actually forced the SCOTUS to rule on it.

 

Its bullcrap. One person should not be allowed to start a war on their own, which, the way things have been for decades, they can.

Speaking about Act of War (and what I thought this threada was going to be aboot). Larry Silverstein Properties (WTC owner) is STillL suing American Airlines claiming it was their fault (liable) for the 911 attacks as they failed to secure te planes.

That is TOTAL BS !!!!

The courts have ruled in AA's side calling it an act if war. The only 911 lawsuit still unsettled.

It's been awhile since I studied military law, but the war powers declaration of the the 70s really killed the need to have a formal declaration of war

Delaring war on China?

A. 100's of thousands of lives would be lost even if non nuclear and nothing reeally acomplished.

B. We owe them a sh!tload of money - you want them to collect?.

C. It would become WWIII as Russia/NK/Iran would back China and Europe / Japan / Austrailia us -- loss of life total in the millions

 

Declaring War on NK

 

A. Would be fine except for the fact they would destroy Seoul and parts of Japan before they went down.

 

Declaring War on Iran

 

A. Why fight a war Israel will do for us

 

 

In all of these -- is there anything for the US to gain?

There was an Assistant Secretary of State from the 70's doing a TV interview on BBC last year that stated that if we go to war with China, our current debt gets canceled out if there is a declaration of war. I can't find a staright answer to this. Any truth to it?

China was just espionage stuff. Iran is mostly blustering although Israel has real cause for concern. North Korea has declared war, but they're like the really annoying kid brother that you ignore because he's just trying to get attention.
