The trend in many states seems to be moving towards allowing jurors to ask questions. Actually most states don't really have a rule on it and it's up to the individual judges. It is a controversial practice though. Many think that jurors will place undue weight on the answer to their question rather than simply considering it as one piece of the overall evidence in the case. There are other issues, like jurors maybe being angry that an attorney objects to their question, but most of those can be worked out through procedural steps (such as the judge discussing the questions with the attorneys outside the presence of the jury).

 

Personally I think it's sort of a dangerous practice that could lead to juries going out on the lam. They are no longer neutrally weighing the case but rather trying to press their own view of it.

I can see this argument. It is the job of each side to make their case. Can the defendant refuse to answer? Even so, I would think that that could sit poorly with the jurors. It could present some issues regarding the protection against self-incrimination.

I would imagine the defendant can refuse to answer. But if they testify at trial and then refuse to answer juror questions, that could certainly have a negative impact on them.

 

That's one reason to do all this outside of the jury's presence. Jury is excused, judge and counsel discuss each question, defense attorney says "my client refuses to answer any questions", and the jury never knows exactly why the question wasn't asked (although they may have their suspicions)

Not the couple photos of her as a blond, but as a brunette, like she is now at trial. I absolutely love her.

She looks EXACTLY like my old girlfriend from years ago. (The one that got away type of story).

Depends on the pic. Sometimes she looks kinda hot in a really slutty way, other times he just looks like a downright skank. :dunno:

What bothers me most about this trial (other than apparently, it's the only news-worthy story CNN can find) is:

 

 

This biitch has COMPLETELY trashed the guy she massacred. Apparently, biitch's can say anything they want - with no shred of proof - and aww, isn't that convenient that the only guy who can refute these statements is DEAD.

 

I really feel badly for the guy's parents. She's called him everything from a chick-hitter to a pedophile - and yet, no proof whatsoever. I just think that's really shiity.

 

If the prosecution has to prove their assertions, I think the D should bear the same burden.

I would normally tend to agree. But after seeing OJ and Casey Anthony walk, I would not be suprised at all to see her get aquitted.

You had a perfect chance to make a joke about her getting off and you failed. For shame. :nono:

Personally, I'm just really grateful that so few people get murdered here in the United States. This way, CNN can dedicate a good 10-12 hours per day on one pretty white girl (victim or defendant) murder case per day.

 

That's just really fortunate for them - and us. Imagine if more than one murder occurred every 6 months? - They'd have to start having different off-shoot networks.
