Thanks, no I haven’t looked. I saw the complaint refers to Norfolk. Went through there once, seemed nice that whole area. But I’ll take a look.

That combined with if she rented it out for less than 6 months of the first year, then yup pretty sure she did.

Any comment on the fact that there is an Airbnb listing at literally the exact intersection you named?

What, do you think it’s definite that she rented it out for more than six months of the first year that she owned it? If it was a POS, she may have had to fix it up first anyway, which would still qualify as it being available for her personal use.

I mean according to you we cant say that based on the indictment she didn't use it for personal use, even though it says that.

But you can just come up with all these different scenarios, lol?

I mean she fixed it up now. Good god.

The indictment says zero personal use days declared and that there was no actual personal use.

I mean what are they supposed to do write every single date and make sure to specify that on that date there was no personal use?

"Zero personal use days" and "no actual personal use" are incredibly definitive terms.

Now possibly they are lying and the grand jury believed them, but also possible that James rented the house to a pimp and he used it as a brothel.

The indictment doesn’t say she “never” used it for personal use, it said she filed tax “form(s)” reporting zero personal use days.   It does not say which year or years that she filed those forms saying that.

I’m not sure Halligan realizes the thing about the first year, as she says the “scheme” went through at least January 2024

It says "no intended or actual personal occupancy or use"

Which everybody but sho nuff would agree means the same thing (if true of course).

This is what you get from RainHauck.  He did the same thing with the illegal immigrant school superintendent.  He just tries to make up any scenario to defend these people and then says he wasn't defending them.

OK you got me, I thought we were talking about statements that they claimed in the indictment to have actual evidence of, not just claims that they might be making up (which you seem to acknowledge above is a possibility).   But when you said the below you didn’t really leave open the possibility that they’re lying.

I wouldn’t act all high and mighty though, you were wrong earlier when you claimed a second home rider meant you couldn’t rent the home out at all.  That was very clearly incorrect.

Powell was not indicted by the Biden DOJ. She was indicted by the Fulton County DA. I’m guessing you have a lot of cleanup on this list.

It notes as I’ve been saying that after 12 months she “had wider latitude to use the home as she wished.”

One tidbit I hadn’t seen before is that she apparently reported rental income on it in 2020, but no other years.  Since the home was purchased in August of 2020, unless she lied about not having rental income on it in 2021, then it would not have “primarily” been a rental property for the first year she owned it.

The family, Nakia Thompson and her children, have lived at the address ever since, according to two people familiar with the home, and until this week, the plan for a more placid existence had largely gone as expected. Several times a year, the people said, a great-aunt who had purchased the house in 2020 with Ms. Thompson in mind would come for an extended stay.

This week, with the filing of court papers some 200 miles north, the plan came to an abrupt end. The great-aunt — Letitia James, the New York attorney general — was indicted by President Trump’s Justice Department. The yellow house, with its gabled roof and tidy lawn, was revealed to be at the heart of the case that Mr. Trump’s chosen prosecutor brought against Ms. James, one of the president’s most prominent adversaries.

In the indictment, the prosecutor, Lindsey Halligan, accuses Ms. James of having misrepresented the purpose of the house when she purchased it in August 2020 for $137,000. The indictment says that while Ms. James indicated to her mortgage broker that she expected to use the house as a second home, she had instead used it as a “rental investment property, renting the property to a family.”

But in June, Ms. Thompson testified to a grand jury in Norfolk that she had lived in the house for years and that she did not pay rent, a person familiar with her testimony said. She was not asked to testify again, and the grand jury that voted to indict Ms. James was not seated in Norfolk, but in Alexandria.<<
