Several SCOTUS decisions coming out today.....

One that just dropped regarding nationwide injunctions.  It's in the birthright citizenship case but related to nationwide injunctions.  Sounds like Trump got a win and the court has partially overturned some nationwide injunctions and said the following:

When a court concludes that the Executive Branch has acted unlawfully, the answer is not for the court to exceed its power, too.

 

More to come on this decision, and others will be coming out as well, so starting this thread to discuss these and their implications.

Way back in 2022 Kagan said she was against lower court rulings affecting the whole country and not just their district. She voted against that.

@Strike, you should change the title and make this thread about SCOTUS biotch-slapping the lower courts' attempted power grabs with national injunctions.  This is a BIG decision that we've been waiting for.  Well, those of us who want true checks and balances, anyway.  :cheers:

Jackson is an idiot.  ACB called her as much when addressing Jackson's dissent in the birthright citizenship case:

As best we can tell, though, her argument is more extreme still, because its logic does not depend on the entry of a universal injunction: JUSTICE JACKSON appears to believe that the reasoning behind any court order demands “universal adherence,” at least where the Executive is concerned. In her law-declaring vision of the judicial function, a district court’s opinion is not just persuasive, but has the legal force of a judgment. Once a single district court deems executive conduct unlawful, it has stated what the law requires. And the Executive must conform to that view, ceasing its enforcement of the law against anyone, anywhere. [Emphasis added]

We will not dwell on JUSTICE JACKSON’s argument, which is at odds with more than two centuries’ worth of precedent, not to mention the Constitution itself. We observe only this: JUSTICE JACKSON decries an imperial Executive while embracing an imperial Judiciary.  [Emphasis added]

Next decision:  The SCOTUS ruled that it's legal for a state to require age verification to try to prevent minors from viewing porn.  

This ruling underscores that we treat minors differently than adults under the law.  Those in favor of cutting off 10 year old boys pee pees should take note.

I don’t call everyone racist. Just those who deserve it. Suggesting Jackson isn’t smart is just ignorant on your part. Calling her DEI is both ignorant and racist, hth

If they want to be technical, Clarence Thomas was the first DEI Justice (although the term didn't exist then) as he was chosen to replace Thurgood Marshall apparently only because he was Black (his legal experience was limited).

Nope, HT is right.  She's a DEI hire.  It's obvious in her opinions and the fact that she has no idea what a woman is.  THAT is DEI almost to the letter.

And calling someone dumb is not racist by any stretch of the imagination.

She was chosen due to her color. That's the definition of DEI.

That doesn't ignore the fact that Thomas' was chosen because he is Black.

I am just pointing out that they aren't being consistent calling Jackson DEI but not Thomas.

Clarence Thomas was picked because of his color. He also happens to be qualified and intelligent. And he overcame a lot. KJB has had it great since birth. Pushed along for only one reason.
