In AZ, except on the freeway from state police, "speeding" tickets are generally "speed not reasonable and prudent." My wife once rearended a car and got a ticket for going "25 in a 0". The reasonable and prudent speed was 0. She was clearly not driving a reasonable or prudent speed in that area. Agree with the second. I thought it was interesting when he said something about her "passing multiple cars," and she responded "it was one car." I thought ooh, she got tricked! But if he said she was under arrest (I didn't go back and re-listen), then he should have read her her rights. I didn't watch the whole thing, but my impression was that he didn't plan to arrest her, but rather was maybe hoping to get a beejer from her to let her go. She's on video, with a cop who eyeballed her speed but that' not what he charged her according to the video. The charge felony fleeing and eluding, but that requires "Intent" in Florida. IMO, good luck proving that without anything she said once he said you are "under arrest" because he didn't read the Miranda. She may be able to fight it by saying she didn't see him but she has her speeding and passing in a no passing area. I don't think the Miranda deal is going to affect much.
