Go back to how this started. You wanted to call them "undocumented aliens" as opposed to illegal aliens. Then you went into a bridge to how them being here illegally is not a crime. I am saying that if you are here against the laws of this country, you are "illegal".

 

As far as whether it is a crime, under Title 8 Section 1325, the illegal alien can be fined and imprisoned for a period not exceeding 6 months. Based upon that, are you implying that we can fine and imprison individuals without them:

1. Getting due process and

2. ever committing a "crime"?

I have smoked pot on the streets of NYC many, many, many times...often within close proximity of a police officer. I have never been taken into custody, arrested or charged w/a crime.

Federal law defines a felony as an offense that is not otherwise classified where the maximum term of imprisonment authorized is more than one year. For an offense to be a felony under federal law, it must have a possible sentence of more than one year, not exactly one year or less than one year. State felony definitions vary. It is officially listed as a federal crime. Granted. Knowing that border jumpers and overstayers are not charged with a crime, I made the leap that a specific criminal penalty did not exist. That is incorrect.

 

For any relevant purpose of discussion, however, being here illegally is not a crime. I stand by the statement. And so apparently does a significant part of the federal lawmaking apparatus, which is currently seeking to MAKE it a crime under which people might actually be charged.
