I didn't say they weren't here illegally. I said they weren't committing a crime.

If it's a crime, tell me this:

 

*is it a misdemeanor or a felony? All criminal offenses are one or the other, are they not?

*in which US criminal court are the offenses tried?

*how many detained border jumpers have been convicted of the specific crime of being here illegally, for the last year in which such statistics are available?

*why is the US House seeking to make it a crime?

There is a law on the books, I concede. It is not used. For practical purposes, being here illegally is not a crime, but cause for detention subject to deportation.

 

Sodomy's a "crime", too. So is smoking pot in Holland.

Go back to how this started. You wanted to call them "undocumented aliens" as opposed to illegal aliens. Then you went into a bridge to how them being here illegally is not a crime. I am saying that if you are here against the laws of this country, you are "illegal".

 

As far as whether it is a crime, under Title 8 Section 1325, the illegal alien can be fined and imprisoned for a period not exceeding 6 months. Based upon that, are you implying that we can fine and imprison individuals without them:

1. Getting due process and

2. ever committing a "crime"?

Yeah, and someone got tried for it in Texas just a year or two ago. So what does bringing up a bad crime to do support your argument that someone breaking the law is not doing anything illegal? LOL

So now it's whether something is effectively a crime and not whether it's actually a crime....LOL....But noone has ever accused Muhammad of dealing with semantics have they? Noone ever wonders why some of us get frustrated with his circular arguments, backpedaling as he's doing now, or spin. I have smoked pot on the streets of NYC many, many, many times...often within close proximity of a police officer. I have never been taken into custody, arrested or charged w/a crime.

 

So, by your reasoning, I did not committ a crime.

I stand corrected. There are federal felonies.

 

Federal law defines a felony as an offense that is not otherwise classified where the maximum term of imprisonment authorized is more than one year. For an offense to be a felony under federal law, it must have a possible sentence of more than one year, not exactly one year or less than one year. State felony definitions vary. When an offense is a misdemeanor under both federal and state law, there is no argument that it can fall under 18 USC § 16(:lol:, which applies only to felony offenses.

 

It's not in section 10101 so next time if you are going to reference something, try and tell the truth.

It is officially listed as a federal crime. Granted. Knowing that border jumpers and overstayers are not charged with a crime, I made the leap that a specific criminal penalty did not exist. That is incorrect.

 

For any relevant purpose of discussion, however, being here illegally is not a crime. I stand by the statement. And so apparently does a significant part of the federal lawmaking apparatus, which is currently seeking to MAKE it a crime under which people might actually be charged.

This is awesome. I didn't know that after you commit a crime, you are no longer guilty of it. I am going to kill some of my neighbors. I guess if they don't catch me in the act of killing them, then my status will be "murderer" but I won't go to jail.

Perhaps I copied it wrong, but I'm not lying. The change in FAA regs cited that title and section. I don't have it up anymore. Look up FAA lighters on google.
