Ok, serious question about child support

When a guy and a girl have a child together and they break up, and it doesn't matter what the reason is or whos fault it was. Why does the woman get the child suppport money sent to her. Even if the money is definatly going to her and not to the child. Why does the s lut always get the rights? Why does the mother have more rights than the father?? That will never make sense to me.

You hit that right on the money. My moneys already going to some other fock. Oh well. I'm a good enough person to not do anything stupid. But I will still pray to God for him to do something stupid for me. Put that lightening to good use my friend.

Terrifying story for you. Sickening and true:

 

 

A guy working at a local factory, UAW...good union wage in the range of $20 an hour....gets a woman knocked up and she tells him she doesn't want support. All is well for about 5 years. The woman goes on her way to becoming a dental assistant and ends up shacking up with the dentist she works for. Time goes on and the woman and the dentist get married. Now I don't know the specifics, but the way the story was relayed to me was that the dental couple made well over $150,000 a year between the 2 of them.

 

 

After getting married, the woman decides the father of her child should have to pay her child support so she takes him to court where they not only deduct child support from him but also 5 years of back support "because it's the law". After all the support is taken from his check, the union worker now brings home a whopping $100 a week. He has a house payment, he has utilities to pay and he has a daughter that he needs to take care of when she is with him...all on $400 a month. He asks the judge how he's supposed to earn a living and take care of his family. The judge says "get another job".

 

 

A few months goes by struggling as best he could and he finally folds and tells the mother that he can't afford to do it anymore and reluctantly gives full custody to her. Upon this, the woman...a dental assistant and her dentist husband....making in excess of $150,000 a year...takes the union worker back to court to have his support raised even further.

 

 

The union worker sells his house and packs up everything he can and lives out of his car in the parking lot of the factory where he works. Clothes in the backseat and trunk and showers in the locker room at work. He faces the fact that he only has 13 years left on this sentence and somehow will find a way to make it through. A few months later, it's raise time. He gets a pretty nice $1.00 an hour raise and things are looking up. The dental assistant and her dentist husband....who make over $150,000 a year....find out about the raise and take the union worker back to court again to have his child support adjusted to compensate for the raise.

 

 

 

 

 

 

 

 

Reaching the limit and realizing he only had 13 years left to pay, he shot himself dead in the parking lot of the factory he worked.

So I'm getting the feeling that you think there should be a middle person?

Someone who would make sure your money is going to your baby to ensure he/she is getting the things needed to survive.

Two things:

 

1) They should use a debit card-like system as they do with Flex Spending. All the child support money must be used for things to benefit the kid. Can never be used for smokes, alcohol, clothing for Mom, etc.

 

2) If the mother gets remarried, the child support is greatly reduced. No need for a triple income family.

I would imagine that a guy could just petition the court to get an accounting of how the money is spent. It is reasonable to request that the money actually be spent on the care of the child if it is child support and not alimony.

I assure you that I'm a veritable expert in this arena.

 

NO, you cannot get an accounting of how the support money is spent. The government doesn't care.

 

NO, your expenses DO NOT MATTER when calculating child support. It is all based upon net-income. You make X-dollars. She makes Y-dollars. Combine the net incomes, credits go one way or the other based upon who is paying childcare and healthcare. Use the chart. Here's the number. This is the percentage of that number that the NCP pays. You can't live - go fock yourself.

 

That said, the above story is inaccurate because FEDERAL LAW requires (via the Fair Credit Reporting Act) that an NCP can be left with no less than $750(ish) dollars after all deductions including child support per month. While it still isn't enough to live on, the $100/week story doesn't fly because it would be a violation of Federal Law.

 

Now, each state may have some little different idiosyncrasies in their (incorrect) formulae, but that's the general picture of the reality.

 

I still fail to understand why the courts make you turn in an I&E form, because none of it is taken into consideration.

 

Finally, it isn't about "the best interests of the children" - it's about "the best interests of the states" - who get Federal Matching Funds based upon the amount of funds collected through the states' CS Programs. There is a financial incentive to maximize the judgements against NCPs and keep them going for as long as they can. Otherwise, the Divorce Cartel would fold up like a house of cards.

Depends upon the state. I know that in some states it is allowed upon petition to the court. Check Indiana, for example.

Indiana allows it in an effort to prove "misuse of child support funds." Now, my best guess is, you would have to have a WHOPPER of a reason... and cigarettes and booze and partying aren't going to pass muster. If the kids are eating, healthy, going to school, and have meaningful housing - I can't imagine any court is going to give you any relief.

If there is a failure to pay for necessities (healthcare or dental, for example), then the person paying would have reasonable cause to know how the money that is being given is spent. I agree, I just gathered from bellyache's post that he was more concerned about her having "play money" and not concerned about the child getting inadequate healthcare, housing, education, etc.

Dental Assistant married Swerski ? Only one I know of that would be that cold and heartless for no apparent reason.

in NW Indiana My Friend got a divorce with 2 kids -- He was told he could not be made to pay more than 30 % of gross income . Judge made him pay exactly that - 30 % of gross ! :lol:

Got divorced when my son was 4. My ex-wife was cheating on me. I paid child support that entire time. He was living with her so it was not an issue.

 

 

Now I am remarried and my wife had 3 children by her 1st husband. They divorced because he cheated on her. He does body work for car dealerships and gets a lot of payment by cash..

 

 

He is $18,000 behind on child support payments since we married 7 years ago. He claims that he doesn't make any money and since he works for himself his wages can not be garnished. During the 7 years he has bought 2 classic mustangs, a new dodge Durango, A new mustang, and a new toyota camry. All of the cars were listed in his new wife's name. Amazing how they can afford all of these vehicles when his wife is a secretary for a health care company...

joint custody

 

 

 

Guy was making like 115 K -- bringing home about 70K take home after deductions. to now taking home 35K

 

he went from having a great house , nice cars , etc ( In Indiana 115k buy alot more than the east coast :pointstosky: ) - to a POS apartment a few miles from his wife's HOUSE !
