You are right, they should sue in court that they were willfully misled into acquiesing. Given the fact it was based off of phony leaked reports, and no evidence whatsoever to substantiate anything it was downright fraudulent.

 

I'm sure if Kraft had it to do over again he would have stood his ground.

So why aren't they?

But don't tell me that there aren't any legal options if they are totally innocent and the league has chosen to take two draft picks away from them for no reason. I haven't even heard Kraft or Belichick come forward and say that, because of the judge's ruling in the Brady case, the lost draft picks are a sham. Nope. Not a word. I wonder why? lol No I don't. Kraft and the Patriots do not have that right under the NFL by-laws, so the court would probably not even be inclined to even consider looking at whether it was poorly investigated or decided because they have no standing to change it.

It isn't worth the try because it is a waste of money, it will be divisive to a multi-billion dollar industry, it will continue to distract from and harm their brand, and they have no chance to win.

I think that position varies, and has evolved based on the evidence. First there was absolute denial, then after facing an array of circumstantial but damning evidence suddenly it became a "so what, everyone does it" excuse, and then the punishment for cheating an lying was just to much.....which really means it was the right amount because then it was at the deterrent level.....so on and on, yes the Patriots have cheated, but their fans are just fine with that.

According to Adam Schefter the NFL told the Patriots to suspend them. And after Roger Goodell denied that he told the Patriots to suspend them on the Mike and Mike radio show, Schefter said he was still positive the NFL ordered them to suspend them.

So the NFL approached the Patriots and asked them to take action on these employee's and the Patriots acquiesced, interesting. Seems as though through their own actions the Patriots at least had some agreement with regard to the behavior of the employees.

Allegedly, the "official" in this case had a son that worked for the Colts at the time as well. In the games in which this official allegedly worked, the Colts were 8-1. :o
