So under TN law, a prostitute who passes along HIV has to register as a sex offender for life and faces up to 15 years in prison and a $15k fine (vs. 6 months and $500), even if she didn’t know she had HIV?

If I’m reading that right, seems unfair and that’s the risk anybody focking a prostitute runs.

If they didn't know I would be okay with not prosecuting.  I just think everyone who does have it and does know it is simply going to say "I didn't know" to try and not get prosecuted.

Unknowingly is the deal breaker with this law and it should be invalidated for that reason alone.

That is the point, one can't tell if they have it for a period of time after becoming infected (I read somewhere that the first symptoms of HIV infection take about 2 years to appear).

Lawsuit by the Fed is stupid.  Disability rights?  GTFOH.

I'm ok with the law for people who knew they had it.  If I'm wrong, I believe a person who is raped is allowed to subpoena the medical records of the alleged rapist.  I don't see why that can't apply here.  If a person tests positive for HIV or AIDS and they know who gave it to them, I don't see why that person can't subpoena the accused's medical records.  If that shows a positive test, prescriptions for medication and corroboration from the pharmacy that said person picked them up, I don't know why that can't be used as proof that the person knew they had HIV or AIDS.

Here in Colorado we have to get our vehicle emmissions checked every two years.  If you don't pass you cannot register it for use on the road.  Should be the same for Tennessee whores.  They should get their vehicle checked every two years for emmissions.  If they don't pass and get an updated sticker they have to keep their vehicles out of cervix  service.
