Trump El Salvador deportation thread. Abrego Garcia is coming back to US!!!

Also can we talk about the ridiculous comments from the El Salvador president?  “How am I supposed to smuggle him to the US?!?!?!”

Uh, he’s in your prison (so we think).  Just put him on a plane.

Do we even know if he’s alive?

U.S. officials on Saturday said that Abrego Garcia is "alive and secure" but who really knows (and I don't trust the source).

You can ask.  And considering we’re paying them, there’s not really any reason that they’d say no, unless they plan on releasing him.

Nope. He’s here illegally

Nope what?  We can ask anything we want, especially since we’re paying them.  They can say no, but then they should have an actual reason to keep him there.  Is entering the US illegally a crime in El Salvador?

Send him a plane ticket. Good luck with the passport.

Are you arguing semantics about the word “facilitate”?

So what. Biden didn’t listen to the Supreme Court.  I don’t see why we would need to ask for an illegal to be returned to the country.  The law says if you’re here illegally you get deported as punishment.

No.   There is NOTHING in the order that says to return him to the U.S.

They said they need clarification on the term “effectuate,” but that the order to “facilitate his return” remains in effect.  Bolding mine:

On Friday, April 4, the United States District Court for the District of Maryland entered an order directing the Government to “facilitate and effectuate the return of [Abrego Garcia] to the United States by no later than 11:59 PM on Monday, April 7.” On the morning of April 7, the United States filed this application to vacate the District Court’s order.  The Chief Justiceentered an administrative stay  and subsequently referred the application to the Court.

The application is granted in part and denied in part, subject to the direction of this order. Due to the administrative stay issued by The Chief Justice, the deadline imposed by the District Court has now passed. To that extent, the Government’s emergency application is effectively granted in part and the deadline in the challenged order is no longer effective. The rest of the District Court’s order remains in effect but requires clarification on remand. The order properly requires the Government to “facilitate” Abrego Garcia’s release from custody in El Salvador and to ensure that his case is handled as it would have been had he not been improperly sent to El Salvador. The intended scope of the term “effectuate” in the District Court’s order is, however, unclear, and may exceed the District Court’s authority.

SCOTUS ruled that he couldn't use the HEROES act to forgive student loans, agreed.

Do you have any evidence that he did use the HEROES act to forgive student loans?

ROFLMAO.  Your own post proves my point.  There is NOTHING in the SC ruling that says they need to return him to the U.S..   Holy fock.

Yes it does dummy.  The district court ruled they must “facilitate and effectuate his return.”  The order to facilitate his return remains in effect.

Now please admit you were wrong.

To facilitate seems different than to accomplish, complete or effectuate.  I know of no case interpreting the word "facilitate" as used by the Court, in this context.  I do know that to facilitate a crime mean to remove barriers to it be carried out.  I do know that one can facilitate an as yet and perhaps never completed act.

Correct.  This part of the conversation started when I said they (the US government) needed to at least ask.

To my mind asking would fulfill facilitating if coupled withpayment of costs and arranging transportation.  I am unclear whether asking is required by the term facilitate.  perhpas an offer of costs and transportation alone would be sufficient.  I don't know.  frankly I don't think anybody currently knows.  I think the Courts will have to clarify matterds. likely after a new round of orders and appeals.

IANAL like you but I don’t know how they could argue they attempted to “facilitate” anything if they didn’t ask. I have not seen evidence that they actually have (it was a media member that did in the clip of Stephen Miller being a racist liar).

But it’s looking like if El Salvador does send him back then we’ll just send him somewhere else.

I’d like to confirm he’s actually in a gang first, which apparently is based on the word of a guy who gave case information to prostitutes

@Engorgeous George, do you think Garcia’a family could have a defamation case against people like JD Vance stating definitively he is a gang member, or Stephen Miller saying “I promise you if he was your neighbor you’d move right away”?

The guy is an El Salvadoran in El Salvador. That's quite convenient isn't it? Double check his claims and if he's not actually a gang member, let him walk out of the prison. If he were a different nationality, a Honduran (for example), a bus ticket to Honduras would be appropriate.

This 'return to the US' stuff is whack.

I believe this is correct and am starting to believe it's more likely than I'd have thought a day ago that ends up being the result.
