Staffers are often there after hours I would imagine working on whatever they do for the Senator they work for. And everything that doesn't fall under official business is probably not considered an act of trespassing, I would suppose. It would depend on how the statue is written.

I didn't say he shouldn't suffer any consequences. 

I just am not sure what he could be charged with that would stick and get a conviction (unless he agreed to a plea) and I imagine prosecutors are grappling with that. Plus, I am sure if he were to fight it might lead to some even more unwanted publicity that they would want to avoid.
