Can you impeach a candidate-elect?

Recommended Posts

I don't think so. The President's party typically loses seats in the House in midterm elections so we'll have to wait until then for impeachments #3 and #4.

Not in any that I have seen.

At this point being impeached is less problematic for Trump than liberals shooting bullets at his head every other week.

Interesting question.  My first instinct is "no" -- impeachment relates to conduct in his official capacity as POTUS, which he doesn't have until 1/20.  And yet, there would need to be some way to remove him if he were to do something so egregious that it demanded his removal (e.g., murderous rampage, misgendering somebody).

My guess is that we'd embark on uncharted legal waters.

The short answer is no. Under Article II, Section 4 of the U.S. Constitution, “The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.”

The president-elect isn’t president and isn’t a civil officer of the United States until they are on the payroll. You may recall Presidents Obama, Trump and Biden establishing offices of the president-elect. They weren’t real offices per se but their transition teams’ stage name, more or less. Federal law allows the apparent winner of a presidential election certain privileges like office space and telecom services but the phrase “Office of the President-Elect” appears nowhere in federal law.

Aren't you an attorney?  Regardless, I'm sure our resident SC justice @IGotWorms will be here to enlighten us with his extensive legal knowledge any time now.

House ballots are still being counted a week after the election, so don't count your chickens yet.

You jest, but Democrats have brazenly abused the process of impeachment before

they will certainly do so again

“democracy “ is not something they respect or care about. It’s.a notional idea they trot out to justify reprehensible behavior
