I posted this earlier in the thread, thought it was an interesting read where the judge was sure to point out that smuggling is very different than trafficking.  He also expressed doubts about the credibility of the evidence against Abrego Garcia, even including the claim of him being in MS-13.

Good point.  He likely won’t be in the country long enough to do it but his wife should be able to file on his behalf.

Will be interesting to see how the prosecution goes.  I would imagine a really good defense lawyer would be able to get him off.  I don't know if he has a public defender or if some firm came forward with pro bono work to help him.

In a civil case the plantiff doesn't have to "prove" anything, but rather just show that it's more likely than not that it happened.  I would think between the testimony and the video evidence that the admin put out, there would be a good argument to a sympathetic judge or jury.

You can read it, I doubt you will, but it details Garcia's abuse claims at CECOT.

So I read the First Amended and Supplimental Complaint which is not an affidavit, though I still took your meaning.  Were I the Court I would have directed the Plaintiffs to refile it within 72 hours deleting the hyperbolic and libelous assertions and conclusions contained therein.  I would have directed them to plead the facts, and where they are alleging unsubstantiated matters to have noted them as such.  I would have directed the Plaintiffs to refrain from emotional arguments and summations of evidence and instead to concentrate on the legal basis for the relief sought.  I would remind and admonish the Plaintiffs that their political arguments, their clear quest for public attention are not a proper province of the Courts.  Complaints are for setting forth facts and the law under which relief may be granted, not for arguing speculative matters.  Here's a guideline, if the respondents cannot simply admit or deny an allegation and instead would have to  argue against a political position libelous of their motive it does not belong in the Complaint.  There will be evidentiary hearings and potentially a trial where it is appropriate to address such matters.

Who would have to leave El Salvador to avoid being imprisoned and tortured himself if he dared to testify (which probably wouldn't even be allowed).

You’re complaining they charged years later.  That’s not what happened with Trump? Also the Feds turned down the election case in NY, seeing as it’s a federal crime. But you saw nothing with the local DA’s office taking up the case years later in spite of that.  Fraud.

Well, the tatoos are symbolic. Depends on what you believe they represent.  See, members of gangs don’t actually tattoo the name of the gang on their hands. Usually. That would be pretty stupid.  So they use symbols. Like the Bloods use three small circles grouped together that looks like a dog paw. There are many.
