Supreme Court thinking of hearing appeal on Harvard discrimination case

Supreme Court defers Harvard case on race in college admissions

WASHINGTON >> With abortion and guns already on the agenda, the conservative-dominated Supreme Court is considering adding a third blockbuster issue — whether to ban consideration of race in college admissions.

The justices today put off a decision about whether they will hear an appeal claiming that Harvard discriminates against Asian American applicants, in a case that could have nationwide repercussions. The court asked the Justice Department to weigh in on the case, a process that typically takes several months.

it’s been only five years since its last decision in a case about affirmative action in higher education.

In that Texas case, the court reaffirmed in a 4-3 decision that colleges and universities may consider race in admissions decisions. But they must do so in a narrowly tailored way to promote diversity, the court said in a decision that rejected the discrimination claims of a white applicant. Schools also bear the burden of showing why their consideration of race is appropriate.

The three dissenters in the case, Chief Justice John Roberts and Justices Clarence Thomas and Samuel Alito, remain on the court. Roberts, a moderating influence on some issues, has been a steadfast vote to limit the use of race in public programs, once writing, “It is a sordid business, this divvying us up by race.”

The court’s willingness to jump into major cases over abortion and gun rights also appear to turn on the new, more conservative composition of the court because similar appeals had been turned away in the past.

Like the abortion case, the Harvard case lacks a split among appellate courts that often piques the high court’s interest in a case.

The Supreme Court has weighed in on college admissions several times over more than 40 years. The current dispute harks back to its first big affirmative action case in 1978, when Justice Lewis Powell set out the rationale for taking account of race even as the court barred the use of racial quotas in admissions.

I'd be shocked if the Justice Department actually asked them to take this case.  Trump's would have but not Biden's.

I've been following this case since the very beginning and thought fairness, colorblindness, and equality had a solid chance of winning even before Ruth Bader Ginsburg's demise. Now, the country has a margin of error to see SCOTUS ban racism for good in college admissions. Of course, the leftist public has gone certifiably insane in embracing Equity bullsh*t, so who knows if they'll duck and cover instead of actually pusing back.  I'm not thrilled about the delay, it's already taken forever to get this far.

Will there be a distinction between public and private universities?

How would it affect the traditionally black schools? Would be hilarious to see those places have to accept whitey.

Not only do HBCU have to admit whitey,  they activly recruit whitey.

If they turn it down how will they ever choose these black students over white students? I for see black students getting left out cause they don’t measure up to their white counterparts most of the time (not all the time mind you but as a whole). That being said, there are some clues that could help identify them as black. I mean the names are dead giveaways. With names like Dabest or Koolaid or Haha you have to guess they’re black :doh:

Agreed.  I think if you look at any school attendance sheet, you can guess race accurately over 90% of the time.  Especially the Asian names more than any other.

Any names which contain an apostrophe - or are a misspelling of a common name - are a dead giveaway.

Exactly, but not exclusively.  There's a girl (13), in my nephew's class with the name Winnie-May.  Even funnier, her middle name is hyphenated too, Khandi-Louise.  The best part?  Her last name is NOT hyphenated.  It's Jefferson.  LOL  Mom and dad are married, have 3 kids.  The youngest girl, Tamika, is 4 and their son, Andre is 6.  🤣

They're really cool people.  They live about 2 miles from my brother and sister-in-law, but right around the corner from me, so I see them all the time.  The grandmother (maternal), is the only person who calls this girl Winnie-May.  Everyone else calls her Winnie... except the 4 year old who calls her May-May.  She hasn't been able to pronounce Winnie, so she just calls her May-May all the time.  Winnie is an oops baby.  Parents were 20 when she was born.  They were married 6+ years later and had their son 1+ year after that.  They told me that they were together since 8th grade.  Pretty impressive... regardless of race.

I recently read somewhere that white students are the vast majority at HBCU.
