I believe that if you allege that a defendant committed a crime to further a second crime, that the defendant should be charged with that second crime, and the prosecution must prove that crime beyond a reasonable doubt.  Otherwise, the defendant is denied due process.

It will be interesting to see if this is argued on appeal.

There’s no due process needed because no crime is charged, and no crime is charged because it’s not necessary to do so.

Thanks, I understand that.  My point is that it seems like NY can magically call any misdemeanor a felony by claiming some loose tie to another crime that they never need to litigate.

I'm not a lawyer, maybe this is normal and happens all the time in states across this great nation.  But it seems wrong.  Especially as an end-around to git the guy Bragg campaigned on gitting.

All final judgements are appealable. Jury verdict is not.

Well but it wasn’t magic and loose ties—the people around him admitted that was the point. There was plenty of evidence to support the existence of a conspiracy.

I'm sure they will appeal everything that crosses their mind, but I like the statute of limitations issue the most, for what it's worth. It's a misdemeanor to falsify business records, and the statute of limitations on that is 2 years. He was writing the checks until 2017, so 2019.  The he was in the White House and Covid extensions might still not be enough to be able to bring charges. Now the felony version of that law is 5 years, but you can't elevate it to felony without the misdemeanor---it's the kind of technicality that SCOTUS loves, get to toss the case without getting their hands dirty.   

Anyway, that would be my play.

He was in the White House until 2021 and so the clock didn’t even start then since the payments occurred during his presidency. Then you have the COVID extension which at earliest would go through 2021 and end in 2022 (which is super generous to him). So say the clock starts ticking 1/1/2022, clearly the case is still in play by the time of indictment. 

As you say however, they’ll try anything they think they can finagle. Whether it happens early enough to prevent the necessary damage to his POTUS aspirations, is another matter.

I agree with you, and that's exactly how I would argue it if I were the prosecution. But there are some unusual circumstances here, like why can't a state charge him if he's in the White House, COVID time extensions, just seems to be enough to muddy the waters. It would still be a massive long shot and pretty unprecedented for SCOTUS to be telling a state how they must interpret the rules of when a crime is time barred. 

*As an aside, I find it strange that we have time limits on when crimes can be prosecuted. But that's an entirely different thread.

Well and I don’t think Dem strategists really wanted this to be the case that was adjudicated before the election. But he was so cartoonishly blatant about it there kind of wasn’t any practical choice otherwise. So it’s kind of ironic then that the case they weren’t sure was the ironclad one they wanted but pressed because they’d look worse for NOT prosecuting something so obvious, became a slam dunk verdict that still may not be ironclad on appeal but also might do the job they were hoping it would. Forget the overall polling; I want to know where independents go as the summer drags on with this issue. They’ll tell the tale. The GOP will be motivated as all hell and even without Trump there would be a huge surge for reproductive care rights…but to me the big wild cards are Gaza and the independents.

Well, after a few days it's patently obvious you're struggling with YOUR sexuality.  You're accusing way to many other posters of secretly being gay to not be a coincidence.  Your projecting is way obvious here because you're so hyper-focused on calling others out for being secretly gay simply for disagreeing.  This is a YOU problem, not anyone else's.

How long you been struggling?  It's clear you're weak and unable to come to grips with it and not the "confident" man you're claiming yourself to be.

I appreciate your willingness to say the quiet part out loud.  This is what I asked in my first comment to you -- to admit that this is all part of a strategy to stop the mean OMB from running for president.  You wouldn't admit it then, but you have now.  

I remember you supporting a woman's right to abort a baby up until birth, because you believed that it was a woman's choice, and that that choice didn't change based on time.  I didn't agree with your position, but I appreciated the consistency of it.

That’s kind. I think I’m pretty tolerant of opposing viewpoints if they’re rationally based and that leaves out any notion of people who are “less than” whether by race, religion, national origin, orientation, gender, etc. And I have the advantage of being innoculated against “but Biden” because I think Biden and the Dems are shittier than the Republicans because they should know better.
