I work in video production and anytime we come close to a Fair Use issue, we are on the phone with an attorney to make sure we are in the clear. For instance, if I host a YT show on editing techniques and grab a 30 second of Heat diner scene to explain the wide shot, cutting, j and l cutting---that would fall under fair use. I'm not monetizing the movie by showing the movie, I'm making money based on teaching people editing techniques and I'm using the clip to educate how those techniques are used in practice. If you watch Honest Movie Trailers, they use clips of movies and but they are making their money by making parodies of movies and movie trailers. IMO---videos like that are the ones that are going right up to the line on the fair use laws...
