The scope is attached to the gun.  To look through the scope he would have to point the gun at Kirk.  If you're suggesting he could remove the scope and look through it at Kirk I agree with you, that would be legal.

Ok thanks. I thought some point Robinson said he had gotten the scope from his uncle so I thought it was detachable.
